I had a similar situation with a dealer last year, car was advertised as having elec windows all round and as having cruise control.

Window on passenger side didn't work and the cruise control was non existent so the car was clearly advertised falsely.

    But you bought it anyway?

To begin with dealer ignored until I got hold of trading standards and they had word with him on his point of view, his argument was its a X year old car what do you expect, TS clearly told him that if you advertise a car has having something like what has been mentioned above and in the op's thread then that item has to be in working order other wise it would be classed as misleading and the dealer could get into deep doo doo.

But he didnt feel any urge to refund you at that point? So much for trading standards eh?

I'm assuming this thread is a wind-up Paul.

    I'm utterly gobsmacked if not.

I think its a demonstration of how !!!!ed up the motor trade has become where dolts like this are humoured.

Anyhow a couple of other faults reared their head with this car and the dealer ended up giving me a full refund after 6 weeks.

Can we assume that something 'proper' occurred, and a sensible reason for a refund was found?

Also, was it an old shed too? Those ML's were a heap of dung when new!
And that my son, is how to waft a towel!

Well on the way home the turbo hose went for starters, so limped home as was nearly there, dealer agreed to repair via local garage.
Two days later found the cruise and window didn't work so complained to dealer which fell on deaf ears till ts got in touch with him, in that time the clutch / dmf's started to go as well. So faced with a repair bill for the cruise control - window electrics and now the clutch / dmf's the dealer cut his losses and refunded me in full.

The car was a 56 Vectra estate.

A bit like folk not being able to calculate which gas or electric deal is cheaper, to such an extent that the government have to intervene

    Must be the schools.

Just for clarification - TS have no interest whatsoever in forcing a dealer to resolve a particular problem, only to advise / direct a dealer to ensure they are following due process.

ie, TS werent fighting on your behalf or to get your car fixed, they were ensuring the dealer didnt continue to potentially not follow the rules on description.

TS would have left you 'high and dry' to fight your own battle only the dealer chose to refund.

I bet it was a 1.9 CDTI by the way.

As I understand it TS said that the dealer had falsely advertised the car and should he not refund me some money for the repairs or not do the repairs himself I could take him to court, however the clutch then reared its head and faced then with a possible bill of £600 + he gave a full refund.

That's fair enough I'd say, you wouldn't expect to have to replace a clutch and dmf a few weeks after buying a car. It's reasonable that the window should have gone up and down too.

However, the mistake of saying the car had cruise and it didn't would never have been a sound reason for refund - even brand new car brochures have a disclaimer advising that specs should be confirmed with the dealer...

I'm no apologist for the motor trade, and if I bought a car where the Dual Mass Flywheel, or DPF or clutch went very shortly after I'd bought the thing; or indeed anything that might have been an advisory on a previous MOT and hadn't been fixed; well, I'd make my unhappiness known. But an unadjustable seat, tinted glass, cruise control? At 9 years old? I'm selling my old banger at 12 years old, and it's definitely 'as seen'. A/C doesn't work, electric windows reluctant and 6 CD player in the boot needs fixing.. I'll answer any questions truthfully, but I expect a bit of intelligence when you buy an old car.
