    I'd be challenging the car to be fit for purpose as a standard once leaving the factory?

    As you didn't purchase thru ebay the ad description is worthless.

    Do you mind providing the Ebay item number so we can see the context of the advert as with some adverts things are automatically added.

    Regarding the seat, the trader should fix this for you.

    To see if you have factory tint, lower the window half way and you can see the difference.

    By the seat do you mean the heated aspect or the fact I can't move it?



    I know now that I should have taken the advert with me, but it's the first time I've bought a car from a dealer. I usually go through private sales. So I thought they would be whiter than white with regards to as described etc. If it hadn't have been for my knowledgeable friend I wouldn't have been aware of the missing items either.

    Ebay populates the avert based on the registration. As you have found, this isnt always correct as many of the items listed are factory fit options.

    The seats are not heated as they are part leather, not full leather and there is no privacy glass fitted.

    Clearly the first owner didnt tick those boxes when the car was first purchased.

    What do you mean plastic panels in the boot?

    If it has a heated seat button but doesn't work then the dealer should fix it, same with the adjustment. Have you checked the fuse for these?

    There is no button for the heated seats so no fuse to check, the seats don't electrically adjust either, they are manual, but they don't work.


    There should be panels that block the boot to the back seats so that when the seats in the boot aren't being used it's a fully flat surface, these are missing.
    Along with the original head unit and the disc changer cartridge.

    Whilst I appreciate eBay may auto populate surely the seller should correct any mistakes, especially ones that make the car appear to be higher end? Also the same info was on auto trader.

    Electric/heated seats are not fitted which is why you dont have that option.

    What aspect of the manual seats dont work? How did you adjust them when you went for the test drive - you did test drive it didnt you?

    The trim for the boot is probably long gone courtesy of the previous owner who have also replaced the head unit.

    All of those were visible when you turned up to inspect the car and you still bought it based on what you saw.

    Based on that, I doubt you have any recourse as you inspected the car before you bought it.

    The only item that (may) need fixing is the seats. If you mean that it doesn't adjust for height but otherwise operates as normal then you may find that it doesn't have height adjustment fitted anyway.

    You weren't happy and you still bought it, now you are looking for excuses to take it back.

    I suspect the dealer will suggest you take your chances in the small claims court.

    i kinda agree with this.. why did u buy it when u werent happy with it, something like privacy glass you can cleary tell wasnt there, cant say you want your money back after that?

    Looking at the car in the pictures it does have tinted glass - possibly not privacy glass.

    Any immaculate 9 year old car is going to have the odd ding or mark. The clue is in the fact that it is 9 years old!

    I know there aren't heated seats... that's one of my issues. Clearly states on the advert there are heated seats!

    I was not an expert on the car, I have never owned this type of car before and assumed these things were standard. I admit I didn't check if the disk changer was complete. It was only when a friend (who has had 2 of these cars) came round and asked to see it that I realised bits were missing.

    Hintza - I was happy with the car when I bought it as I though it was fine. It's only now I've realised I have been sold something that a) is incomplete, and b) doesn't match the description I am annoyed and want to know what recourse I have. I will take him to court if he wants to go down that route as as far as I'm concerned, and SOGA is concerned it doesn't match the description of the advert.

    Now if the dealer wants to fix the issues then I am more than happy to go that route, however I do want the heated seats so he's going to need to source a new interior!

    I absolutely realise that I should have known better now, but as stated I thought buying from a dealer was safer and that I would be getting a good buy. I appreciate you all think I'm a mug however I just wanted some genuine advice not some keyboard idiots trying to make out I'm looking for excuses.


    Thank you for those who have been helpful and provided good solid advice and links. I will be speaking to OFT and the dealer to see if we can come to some agreement.
