PCN from my Dr's/Parking Eye

Hi guys, I just had a quick question with regards to appealing a PCN from Parking Eye
I recently visited my GP who offers patient parking. They have done for years but recently, without my knowledge, introduced a scheme where you have to sign in your registration number if you use it. Apparently it is sign posted but when I came in no one was on reception and I carried on to see my Dr.
7 days later I received a parking ticket for £100 for using the car park and wish to appeal.
Am I within my rights to appeal given that I was there legitimately for an appointment?

First thing you should do is see the receptionist and tell them what they will know that you were a bonafide patient with an appointment and they should get that fake ticket canceled.
If they don't, yet they ought, but if they don't...come back here for advice. But whatever you do DO NOT PAY PARKING EYE A PENNY.
(One thing you could do whilst on here is to do a search of posts re Parking Eye, a 'soft' appeal to them, an appeal to POPLA.)Got a ticket from ParkingEye? Seek advice by clicking here: Private Parking forum on MoneySavingExpert.:j0 -

You've got the right to appeal whether or not you were there for an appointment. But as you did have an appointment you have a very strong case.
Was the 'ticket' based on ANPR cameras?
I think my first port of call would be the Doctor's Surgery, show them the letter from PE, tell them how much stress this is giving you and demand they contact PE and get his thing cancelled (they will have the power to do so). Don't be fobbed off by the receptionist, ask to see the practice manager if necessary.
If they won't, ask for a Doctor's appointment, telling them that you will now need a prescription for tranquillisers as this is giving you immense stress (don't worry, you won't need them - we'll comfortably see you through this).
I'm not meaning to ask a personal question here, but your answer may strengthen your case further - do you have any kind of disability? Just a yes or no will suffice, if yes, there's potentially a whole heap of trouble ahead for PE. And our disability advisor (Coupon-mad) would, I'm sure love to get her teeth into this - she is formidable!
That's it for now; come back and let us know how you've got on. All of this stuff has a time limit (28 days to get in an appeal) so it doesn't have to be done at breakneck, but by the same token don't let the grass grow under your feet either.
You're in good hands here. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thanks guys!
Cant believe the amazing response. I called the practice and they said its nothing to do with them and its a separate company that deals with tickets.
In response to your previous questions I was there for a simple blood test and they recognised my number plate leaving and entering the car park (which is free by the way, no pay and display), so yes ANPR
Im going to head down there now and ask for an appointment slip to prove I was there for an appointment and also ask to speak to the manager. Will keep everyone updated but I have to say thank you for your speedy responses!0 -
This has got to be cancelled, there is no loss to the doctors surgery, how can there be when they don't sell anything? In this case I would simply go to the doctors and demand they cancel it.
Or send this to parking eye
Name
Address
Date
Dear Parking Eye
In reference to the invoice xxxxx dated xxxxx, at xxxx doctor's surgery, the keeper was attending a pre-arranged appointment at the surgery, attached is a copy of the appointment.
The keeper demands that this invoice is cancelled immediately, and denies any liability to your company. If you reject this appeal, per version 2 of the BPA Code of Practice, the keeper requires a popla verification code to appeal independently within 35 days of this challenge.
Faithfully

We don't need the following to help you.

If it's nothing to do with them, then ask them who it is to do with?
So you might next be writing a 'soft' appeal to PE. Ordinarily it would be short, sharp and (not so) sweet, but despite universal abhorrence of PE on here, they have cancelled charges where there has been some evidence shown - shop receipts for example. So send them a copy of your appointment, say you weren't aware about keying in your car number, and ask them to cancel it.
See how that goes. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Check out the requirements for signs with the BPA COP section appendix B here.

They need to be 100% compliant, so see where they have failed!0 -
hi guys, just an update, I went to the dr's surgery and asked to speak to the practice manager. She immediately didn't want to have anything to do with it and gave me a pre printed sheet from parking eye saying that the staff at the practice have no power to deal with appeals and to write to them online etc.
The practice manager also said that a few people had been coming in and they forgot to let people know about the charges because the systems meant to be active last week.
I will definitely be using the template above so thank you so much but I have to say a big thanks :T to the support and quite prompt responses ive had here!0 -

Complete rubbish. I presume the practice hired PE, or did they just wander in off the street and issued tickets without the knowledge of the practice? What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
If the OP was of a stressful disposition and this made him so ill as to need to see his GP, what would the GP do - prescribe tablets or cancel the charge - he would have power to do either?
Interesting hypothetical situation. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
