They could try...but so far none of them have shown it to be 'a genuine pre-estimate of loss' to POPLA!
But there are so many points to a POPLA appeal even if a PPC managed to jump that hurdle they would fall at the next one! Here you go, this gives you loads of links for examples of strong appeals for POPLA stage:

PPCs don't seem to be able to get their head around the phrase "a genuine pre-estimate of loss". They try to include their business's fixed costs, such a staff wages, uniforms, office rent, paper clips. etc. Of course none of that is a "loss" caused by somebody breaking their rules. Anyway, any genuine loss that has occurred must be that suffered by the landowner, and not the parking company. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

So they rely on non MSE people who just pay up..0

The more that I read up on the law of contract and agency the more convinced I am that PPCs rarely if ever have the right to sue for unpaid parking charges. The contract for parking if it even exists is not between the driver & the PPC but must be between the driver & the landowner. If there is a breach of contract then it's the landowner that must sue the driver not their agent.
It's terrible PR of course to sue your customers & bad enough when they genuinely owe you money let alone when it's made up parking infringements.0

Yes, I am afraid that so many people are fooled by the official looking paperwork, full of quasi-legal mumbo-jumbo that they just pay up.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I haven't heard back from them yet. I'm getting a bit worried - only because I've just seen on another thread that someone got a CCJ for a parking ticket from a private company!!:(0
-
You can't just get a CCJ like that. First it would have to go to court, then you lose, then you fail to pay whatever the judge orders within 28 days. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Well I've had one before, so I don't even want to go near to risking it to be honest. The guy who got one had moved house. I'm also about to move house. Mistakes happen, and you don't get your post forwarded..0

Then tell the parking company and DRP that you are moving house then they will have no excuse. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I thought I was advised on here not to contact the parking co. unless I heard from them first.
 What is DRP?0
