    OK, thanks. So I have a leg to stand on in the sense that it was misleading when I bought the ticket? Or they are all ovecharging in general and that's why people win their appeals?

    Just follow the advice of post #4 and wait for the notice to keeper, then send off the challenge to them
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    It's fair enough - some people will want to pay rather than cope with all the stress and harrassment (or fear of) which could follow.

    I know what people are saying and of course I'm disinclined to pay as I did nothing wrong, so I probably won't pay.

    Surely not worth the hassle of them paying £27 plus VAT..

    So from what I can glean this type of thing is a replacement for clampers - where fees used to go through the roof - this kind of things has been stopped? So now they have no way really of forcing payment - the charge notice does have a threatening tone - mention of the DVLA and collecting the payment etc; almost as though "we can find out where you live " blah blah.

    There is an alternative course of action open to the OP not referred to previously.

    The OP seems to acknowledge that they owe "something" and were perfectly happy to pay the advertised tariff and, indeed, attempted to pay albeit unsuccessfully. Arguably (I do emphasise that word), APCOA are owed the charge the OP was happy to pay them.

    On that basis what is to stop the OP writing to APCOA and offering them the unpaid day rate by way of settlement? They haven't yet incurred "substantial costs" (by applying for DVLA RK data and then issuing a Notice to Keeper) and, like all potential parties to court action are obliged to minimise their losses. Ignoring the offer, rejecting it out of hand and - almost inevitably - not making a counter offer (e.g. We'll accept the unpiad tariff charge plus an £X "admin charge") will leave them with nowhere to go should it ever go to court. Always keeping in mind that APCOA have yet to step inside one.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    If they don't keep to timeframes and the bpa CoP they time themselves out. And AOS members have the ability to gain RK details from the dvla so they are just saying they can. It's all part of this scam of scare tactics and quasi legal speak that reels in the mugs who pay

    Good point - I have not paid the £7 charge for the day - but First Capital Connect are the ones who lost out from this. I would indeed be willing to pay the £7 plus a reasonable admin charge - say a tenner. But I think what other posters are saying is that if I offer this I open up a huge can of worms. The truth is I made a mistake and their machines are bloody unreasonable when you are going to catch a train - and there are far too few of them in a massive car park - it is 2 mins' walk each way to get to one from where I parked..when catching a train this is not ideal..

    Yes you made a mistake, but it doesn't allow a company to penalise you for that.

    If you failed to check out of a hotel by the stipulated time, normally 9ish the next day, the most they could really charge is the daily rate of the room. They wouldn't be able to charge 10 times that daily rate!

    The same principle as this, these are not penalties that have statute law to back it up, this is an alleged breach of contract only.
