    There was an interesting addition to the Times T&Cs this morning:

    TERMS & CONDITIONS: You must be 18 years old or over. Entry open to residents of UK only. Winners will be selected at random from all entries received for each hour. If there are no entries in an hour, the winner will be selected from all entries received in the previous hour. There will be 1 winner per hour and 12 winners for the competition. The competition starts at 9:00 on June 15, 2013 and closes at 20.59 on June 15, 2013. Each hour will run from XX.00 to XX.59 (for instance, the first hour is 9.00 to 9.59). Draw will take place on June 17, 2013 and winners will be notified on the same day, June 17, 2013. Each winner will receive a Nokia Lumia 520. The prize is non-transferable, non-refundable and cannot be exchanged for cash or any alternative. The prize cannot be sold or auctioned. Promoter is Times Newspapers Limited. By entering, any subsequent prize winners agree to allow the free use of their names and county for publicity and news purposes during this and future promotions by TNL or any associated or subsidiary company of NI Group Limited.

    I'm sure that's never been in their terms before! How on earth would they enforce it?

    Assuming they found out would they bother to take legal action? I doubt it.
    They might ask you to return the item/item value as you would have lost your entitlement to it, much more probably they would bar you/your household from winning any further competitions run by their group of companies and possibly promotions on other sites if they were the prize provider or other promoters were simply happy to bar you anyway.


    Or they could use this to name and shame
    any subsequent prize winners agree to allow the free use of their names and county for publicity and news purposes

    They could make a civil case that you made a contract by agreeing to the T&C and sue for breach of contract. But they would then have to prove that they had some loss (material loss? or just loss of reputation?) due to your breach. I don't see how they could.

    About the only case I could think of was that if they wanted to go on using your image and a distinctly identifiable prize in promotional activity and you had sold, transferred said prize to a complete &^$%$* who was appearing on Jeremy Kyle and Polica Camera Action with said prize. Hence damage to reputation.

    Or would they claim that they did not transfer ownership of the prize to you - only an unlimited use of it which is for you and you alone. In which case, a) the T&C aren't sufficient to establish that and b) when it wears out - you can't throw it away - you'll have to dump it back at their Head Office Reception:D
    I need to think of something new here...

    car dealers, and ethics.. hmm..

    peoples's circumstances may have changed, since entering any comp- might be worth seeing what car (or any prize) is worth elsewhere, before taking dealer's offer.
    Long time away from MSE, been dealing real life stuff..
    Sometimes seen lurking on the compers forum :-)
  • Competition has a prize for a car worth £20,000......

    50% of people entering want and need a car.....

    50% don't and would probably sell it because they need the cash....

    A small group of people decide not to enter because it's unethical....

    A couple of months passes by and the winner gets selected.....

    Person who didn't want a car wins it and sells it......

    That person is £20,000 richer.....

    What does person with ethics have?.....

    Zero, zilch, nada.


    Moral of the story? Why let somebody else be £20,000 richer who didn't deserve it (in your opinion) when that could have been £20,000 in YOUR bank account?

    In an ideal world things would be done more fairly but unfortunately they are not. Why screw yourself over when you could win something beneficial for yourself and your family?
