Wrongly assigned mobile phone contract - won't cancel it

Hey all, long time lurker first time poster here :beer:

So I took out a mobile phone contract with Orange mid 2012, they rang me up December 2012 offering a mobile phone upgrade for just a 6 month extension of my contract. Great I thought, its win-win even if the phone isn't any good, I agreed and the phone came and it was pretty crap so I sold it and thought that was that.

Little did I know the a-hole on the phone signed me up for an additional 2 year contract rather than extending my current one! Unbelievable... whether it was a mistake or intentional who knows but I know where my opinion lies *cough*fat commission cut*cough* :mad:

So I rang them up and was told I shouldn't even have been offered an upgrade after 6 months in the first place and they claimed they could not cancel it without the original phone which wasn't possible
to get back. They refused reasonable, mutually-beneficial resolutions I offered them i.e reimbursing them for the phone or going ahead with the originally agreed terms.

Because I'm not paying for a contract I didn't sign up for this meant I couldn't pay for my original contract either..

Sooo now it's being passed on to a debt collection agency and it's pretty clear I'm in the right here and Orange are at fault so what are my options here?
Oh and they have also refused/ignored my requests to get a copy of the original call made to me in December -_-

I'll be filing a case with CISAS, the 3rd party mobile comms. dispute handler but god knows how that will turn out, if it's anything like talking to the monkeys at Orange...

Was possibly thinking small claims court but I'm no expert here, opinions?
Ideally I'm looking for the debt written off and bad credit removed.

    You seem to have no proof of that 'upgrade' phone call content.

    Also I take exception to your abusive descriptions of the people who you have spoken to at Orange.

    Anyone would feel exactly the same way in my position I'm sorry if you're so easily offended. That's what happened and no because they with held evidence from me.

    Don't you get a letter in the post saying something like thanks for staying with us for x number of months.

    Shall have to keep an eye on this thread, will be interesting.

    OP has already said that the upgrade phone was sold on as it was "crap"

    I think 'original phone' meant the upgrade/new contract phone, in which case he/she sold it.

    How long was your original contract for?
    If you were expecting to have extended the original contract for an additional 6 months, why have you stopped paying?

    Your argument is around what happens after the original contract end date + 6 months....not what is happening now!
