Returning Personalised Goods

I've just had a birthday where friends clubbed together and bought me a canvas print. They've spent a fair bit of money on it, but it really isn't to my taste.

I realise that the sales of goods act excludes and goods which have been personalised, but wondered if anybody knew if this always holds true, or whether certain companies will be more lenient than others.

    In what way is it personalised - is the picture from a catalogue (made to order) or is it your/ their own picture they have submitted?

    Thank them profusely and put it on the wall in a spare room etc and be grateful for having such good friends.

    Obviously if it hadn't been so huge or expensive that's what I'd do. Wasn't really the kind of advice I was going for.

    With regards to how it's personalised, yes it's a photo montage.

    As you are not the purchaser you have no rights and would have to rely on the companies goodwill.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

    That's exactly it. Just wondering if there are any such companies out there who would show that kind of goodwill.

    In this situation I think you'd even struggle with John Lewis and the likes - if the item was returned it would be scrapped.

    You might get a discount on something else, but even that would be a goodwill gesture.

    The spare room idea is a good one!

    Incorrect. Personalised or not, it is covered by Sales of Goods Act.

    SoGA however is protection where goods don't conform to contract. It does not provide any kind of cooling off period or similar.

    You only have a statutory right to return goods if purchased via distance means (Distance Selling Regulations), in which case yes personalised goods are excluded from the right to cancel aspect of it. There are other types of purchases that statute places a cooling off period for, but none seem relevant to you.

    Although it is correct that any statutory rights are with the purchaser (usually).

    basically you are asking the company to take the hit on the cost of the montage.
    then provide you with something else from whatever money is left.
    A tall order methinks

    I don't disagree. There were a few minor things wrong with it, so I'm hoping that might be a way, but unlikely I agree.

    Was more interested to hear from people who'd been in the same situation; I'm aware that the law is in no way on my side.

    To further compound your problem YOU didn't order it so YOU have no contract with the manufacturer/vendor.

    So it may well be that those who ordered it approved it and accepted it as it was which would make your chances of getting a 'refund' even slimmer. I seriously doubt that the company will have any sympathy whatsoever for you, as the recipient of this. Why should they take the hit for the gift your friends decided to purchase for you?

    Suggest you go with Pullip's advice on this!
