When people in the UK say they have appointed a lawyer it's usually not the case.
If it was they'd be more likely to say they've appointed a solicitor.
When it comes to a banking dispute it would be rare in the extreme to pay for legal advice before exhausting the bank's complaints procedure or the FOS option. After all, why pay for something that can be done for free?0 -

A lot of people on this thread seem to be dead set on picking holes in my story rather than being supportive and offering any constructive comments towards me getting my money back, I'm not a fan of that
Tomorrow the bank opens again, the bank manager and the manager on the phone told me it'll be resolved tomorrow, I don't hold out much hope, but will be going in branch tomorrow to find out!

In your case there is NO ADVICE that can be given to help your case. You will have to let Santander do what they need to do.
TBH. As someone who works in card based services. I would ignore anything your branch manager says.
They have NO POWER or IDEA of what the fraud department are doing or even where your case is in its way through the system.
Best advice STOP TALKING TO THE BRANCH and only deal with the department involved in your case. Pushing them will not help get it resolved any faster. These cases take as long as they take, as often they are having to deal with other banks (possible oversea's) which will work in a diffrent way. So much of the info they require will have to be providd by 3rd parties, which they have no control over.

Is right in many ways. having a Lawyer, will NOT help your case. They cannot do anything to move things along. In fact they may hinder your case if they start sticking their nose in and start contacting any of the parties involved.
In fact it may have the revese effect as many guilty parties start by stating "Where is my Lawyer" and they will get involved.....
So you need to take a step back. Relax, let Santander do their thing and if not happy then you can raise a complaint.
In this case raising a complaint while they are dealing can slow things down. As the department dealing will need to refer to the complaints department before they resolve anything and then may end up going back and looking over things again...Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
Can we please stop asking the same questions over and over again? It's getting very tedious. I try to answer and reply to all the questions people are having about this, but people seem to be raising the same points over and over again (lawyer, business account, tax, msb) all of which I have already replied to, unless you have something new to add, please stop.

Also you want to have your cake and eat it. You want Bitcoin to be a currency, but you also want it to be a "voucher" so you don't have to register as an MSB and deal with all those pesky regulations like "identifying your customers" and "investigating the source of funds" - two issues which have quite dramatically now bitten you on the a*se because you think it's someone else's problem. Here's a thought - if you want Bitcoin to be a legitimate business, how about you actually treat it one rather than trying to evade all the legal obligations of legitimate businesses?urs sinserly,

@dalesrider Thanks, this is useful advice, I called up this morning instead of going in branch, they tell me they have now assigned a fraud investigator to my case, and taken my mobile number to contact me if required, they say 24-48 hours, so now we do more waiting
They did indicate to me that even after all this time they have not looked at the evidence I sent them, crazy!
@opinions4u, as I previously mentioned, he was on retainer before this even started to help me deal with all the legal uncertainties surrounding bitcoin.
@JuicyJesus It's more that I can't register as an MSB because bitcoin isn't legally a currency, and I don't feel that should be the case. I do feel I should register as a MSB, but afaik we can't because...they think it's a voucher, I am of course going to take steps to try and make sure things like this don't happen again, although that's something that isn't exactly easy to do, this is all information I have mentioned previously in the post. I also feel the need to point out that legal speculation on the subject is rather pointless, I am directly in communication with the HMRC on the subject. Your accusations about how I have no desire to be a legitimate business is ludicrous and rude. Until the HMRC replies to me speculation on the situation is pointless.
I am unfortunately going to have to stop replying to people who ask me questions I have already answered in the thread, it's really cluttering it up and generally not helpful towards the thread. The aggressive, unhelpful and off topic comments some people are posting need to stop.0 -

Why is it crazy that they have not got round to looking at your evidence.
No idea how you sent it in, but most banks now work with a system that anything sent in, is sent off to be scanned onto your account and will then be looked at. This can take 2 days to get onto your account.
Also you will not be the only case being handled.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -

Lawyers tend to know little about banking practice. Relying on them to advise you on areas outside their expertise is foolish.0 -

What I do is a walk in the park compared to this type of case. Given I had 2 months training, before starting. Now it is a neverending learning curve due to constant changes in regulations. Both from card providers and the regulators....
You are never going to simply pluck people off the street and say off you go look at this and what do you think...
