Experience with Homeground Management Ltd

No Correspondence was received by many of us, no terms and conditions etc. End of last year out of no where, i received a letter from them demanding money and also additional charges. I was furious as, I had no idea who this company was. I complained but no reponse was received with regards to my official complaint. I paid the ground rent to them when they sent some emails and when i confirmed with neighbours that they had taken over Trinity.

    This year the firs letter i received from them was in February , threateneing me that they had referred me to the soliciotors as i did not pay the ground rent. I was confused and contacted the solicitors who advised that they were referring to this years payment. The ground rent for this year. However no correspondence was received by myself and many others in my block. I contacted Trading Standards who advised i Pay the ground rent but not a penny more. I did so and then received a letter from the solicitors saying that the ground rent paid was not sufficient and i had to pay £292 by the 17th April 2014. Initially there was a £100 charge. They have threatened they will increase this charge if i dont pay even though i have paid the ground rent. This is a total unfair practice which I am sure is illegal and against consumer rights. I am taking HOME GROUND MANAGMENT to court for the way we have been treated. This is a unfair practice as trading standards stated and i need as many people to sign this petition who are also suffering as a result of this unfair act.

    Just produce the evidence of your payment of ground rent,and just use the info from Trinity.

    If the purchasers baulks, then under sct 47/48 of the landlord and tenant act 1987 and Sct 166 of CLRA 2002 if the landlord does not provide their actual address and one in in E & W, and a PO box doesnt pass muster, you are entitled to legally withold the amounts.

    Something your solcitor should know.....

    Yeah, I think we got the point there mohsade!

    Good luck taking these clowns to court!

    You could always ask the solicitors for a copy of the ground rent demand and also check your lease for the date the ground rent is due.

    The good news for us is that you do not have to pay your ground rent until you have receive a demand, using the correctly prescribed form and supported by the right documentation informing you of your rights. Until you receive that you can ignore ground rent demands.

    Ground rent
    Ground rent is a payment made by the leaseholder to the landlord as a condition of the lease. The payment of ground rent (as with any rent) is specified by the lease and should be paid on the due date. Although it is the leaseholder's responsibility to pay the rent, this must be subject to prior notification from the landlord who must use a form of notice prescribed by Regulations. The rent cannot be legally recovered by the landlord unless he has first asked for it.

    Notice for payment of ground rent

    The leaseholder is not liable to pay the ground rent unless the landlord has demanded it. The demand must be in the prescribed form and must specify:
    • the amount of the rent due;
    • the date on which the leaseholder is liable to pay it, or if the demand is sent after the due date, the date on which it would have been payable under the terms of the lease.
    The date specified for payment must not be less than 30 days or more than 60 days after date of service of the Notice, or before it is meant to be paid in accordance with the lease. It may be sent by post to the address of the house or flat to which it relates, unless the leaseholder has previously notified the landlord of an alternative address.

    The Notice of Demand must also include:
    • the name of the leaseholder to whom the notice is given;
    • the period for which the rent demanded relates;
    • the name and address of the person or company to whom the payment is to be made;
    • the name and address of the landlord (or agent if applicable) by whom the notice is given;
    • certain supporting information, provided as notes to the Notice.
    The landlord cannot begin any legal steps for recovery of the rent, including action for forfeiture and possession, unless he has previously served the demand in the correct format, given the correct period of notice, and the leaseholder has failed to respond.

    So...perhaps there is grounds here to recover any legal fees people have paid because of being bullied by Homeground and their lawyers if Homeground hasnt used the right form or followed the above steps?

  • Can anyone who has managed to contact Homeground possibly message me with any details? I have tried the number from a previous poster and the man answering the phone said they are not there and he has no way of contacting them! We are literally tearing our hair out...they are holding up the sale of our property as they have not responded to my solicitor. I would be truly grateful for any help. Thanks

    I'm in same position as many others, our sale/purchase potentially falling through as neither ourselves nor solicitors can get a response from them despite numerous letters or emails. Has anyone got a telephone number for them? I tried the one previously given but they just keep telling me they don't work there so am having no luck at all! I would be so grateful of anyone can help!

    My son is in the process of selling his apartment and has been paying Eddisons for the ground rent. It now appears that he should have been paying homeground. Eddisons have tried to contact them on his behalf as they are demanding solicitors fees for non payment, but they won't respond. My son now has to pay £582 to the solicitors plus £200 to obtain the info he needs for the sale to complete... As he's unable to speak with anyone at homeground he will have to pay the fees.....can anyone offer any advice please
  • received a letter for outstanding ground rent and £423 legal costs from law firm JB Leitch. upon ringing them they said it was because Home group mgmt were sending the bills to a different address, ie; not the one that the law firm used to fleece me for money. they then said that this was with in their rights and home group mgmt were not wrong in sending it to the wrong address. she had standard answers that she was repeating over and over again.

    tried to call homeground but no joy. have mailed them and recieved reply from hannah who stonewalled and referred to solicitors and said she will now not deal with me on this matter, depsite my offer to pay the oustanding bill minus legal fees, immediately.

    thoroughly unprofessional firm and i am surprised this is even legal. its nothing more than a shakedown for money and they are completely insulated from any fault or comeback.

    will pay them and the solicitors money they want as i have a respectable job and i am not reliant on shaking people down for money, to feed and dress my kids.
