How did it lurch with his foot on the brakes?

If he has to drive many different vehicles does he not check the clutch/brakes/gearbox?

I worked as a recovery agent, And taught to test everything like that. If it doubt winch it on.

NO Dukes of hazard jumps off the ramps. Crashing customers cars into the truck was frowned upon.

I used to buy cars from auction, and I spent a good half hour testing every one before I went "off site".
Who on earth would just drive away in a car they were not familar with?

Your understanding of "fault" is what is flawed.

Buying a 9 year old car will have a few issues... as a result of wear and tear. We don't know of the cars mileage, service history, condition, the life expectancy of components in question etc.

SOGA states the following with regards to the terms implied by said act:

So back to your original point:

It shows a significant flaw in your understanding of the law!

No, sorry but my understanding is perfectly ok thanks.

The components which are probably affected here would be those as to be expected to last the lifetime of the car (i.e. NOT wear & tear) as such the SOGA will apply. If the car was only purchased a week ago, it is not for the OP to 'disadvantaged' by the car's previous service history ect. That is the responsibility of the seller as he is deemed to be the 'expert' and would be expected to of inspected the car and ensured it was fit for the purpose and of satisfactory quality prior to selling it.

In this instance, the faults are assumed to be present at the point of sale thus the responsibility of the seller to rectify. However, it is equally the consumer's responsibility to report the fault(s) to the seller in the first instance and then return the car for him to investigate and arrange repairs as necessary.

When the poster states ect, instead of etc..you know you are on a fail. All other text correct, makes the post incorrect. So the story remains a story, part of it may be true...most made up?

If a poster can't clarify basic principles, then don't post!

Think that's aimed at me. I think the odd typo on here is allowed but for the record, I do humbly apologise. But the nitty gritty of my post is, i think you will find, correct. It also appears from the OP's update, that the seller has confirmed this as he has accepted responsibility (and should be commended for doing so).

Poster could be a follower of Molesworth. Using 'ect' in messages is something my daughter and I do all the time. I sometimes use it deliberately in forum posts as a kind of dog-whistle to see if there are any other St Custards fans out there.

Are you and your daughter mentally deranged, or do you deliberately steal the English language, using accents that are not part of English langage?

Molesorth, and St. Custards, I'm not even bothered to research. I presume you to be a) idiot, or b) an idiot.

Although that wasn't aimed at me, I think that is a little over the top TBH. I apologised for my using the abbreviation etc incorrectly but was it really necessary to comment further unless it bore any kind of usefulness to the thread?

I always wondered why i don't post much on here and you lovely reply has just reminded myself of why.

In future i will just ask a professional (lets face it i can afford it as i have a good property portfolio and i own my house and all land round it for 2 miles outright drive bmws and range rovers oh and also help out people like yourself ratboy (dss) with keeping a roof over their head) and not a silly keyboard warrior types like yourself that seem to be on the forum a very lot putting people down for silly spelling errors ect ect ect :) saying everything must be made up yada yada yada

thanks for the good old laugh i had when i read your post

a warm thank you to the genuine people that answered back which messages i have forwarded on to them.

I don't think i will be back on here as i am fed up of all the keyboard warrior types that think they are smart who probably still live at home with maw and paw and who like to put people down because lets face it they dont have anything near to what you have.
