sold car that had 2 serious faults now had a bump

Hi this is regarding my sister in law she was sold a small runabout from a small car dealer in glasgow .

They were told it had no faults she test drive it and it was fine to drive so she took hp out on it its a 04 plate car (i know but its not me).

Well after shes was mucked about by the dealer saying she could pick it up this day that day ect they said it was getting its sump and strainer changed ??? .After all that they got the car last thrusday and ther hubby drove it home and the car didnt feel right but the dealer was closed as they picked it up after work 7pm.

She says he hubby was pulling off the slip road and the car went into neutral by its self its a fiat panda auto they bought but it went back into auto just by touching the stick so he thought it was just a clitch but as soon he went to the petrol station the electric power steering light came on steering went heavy but after refuelling went off???

Car sat untill next day when my sister in law went to use it and it was stone cold and it started but lurched (as if slipping the clutch)forward scratched another parked car. Litter damage was caused so no claim on insurance as they are paying for a dent and scratch man to repair that car. Their head light has a small hairline crack in itbut that was going to be repaired by them.

So hubby takes the car out to try and see if the fault will return and to cut and long story short they do the next day many times the power steering light comes on the steering goes so heavy it jumps into neutral so many times he is nearly involved in two accidents as the car just cuts into neutral and the steering light and gearbox warnings com on again and again. Hes driving back from work like he does and as he was slowing down to turn at a junction the gearbox again goes into neutral and the power steering goes really heavy as he is turning locking the steering so he hits a large bollard that dents the wing and cracks the drivers light badly.

They phone up the garage to complain and all they get it yes bring it down so they do and thats where i come in i followed them down and the dealer was trying to blame them saying the bumps caused the faults ect ect they have looked up on the net and these are very commen faults with this clutchless manual auto box as well as the power steering light coming on but the dealer is trying to blame them saying the bumps caused it.

After myself contacting my lawyer on site at their yard he then stated he would take the car to 2 dealers in the area for fault codes to be read ect ect but if he checks these faults on the net they normally dont leave fault codes. Dont ask me how but its well documented on the next even with a tech plugged in to it and the fault occurring the scanner doesnt pick it up but the repair cost for the steering is 200 pounds and the repairs to the gearbox about 1000 pounds if its something to do with that auto ecm computer. They are going to get the wing and the light replaced only if the dealer fixes these faults but they want to know what their rights are regarding the car getting these faults repaired from him as they dont trust him one bit.

Also they were give an older car non auto to drive home in but wait for it after showing her hubby that he was insured to drive it on their policy it turns out its not on the database and was never insured. As i checked it on ask mid and its wasnt up so he phoned his insurance who then checked to see if any policy was held on it and no there wasnt so if he had been stopped he would have got points on his licence he is so angry right now he has had to pay 22 pounds to cover it for a few days on his own policy as he doesnt trust the dealer word anymore .

What are their rights . What can they expect he dealer to do ????? sorry if this has spelling mistakes ect i have uploaded it from my phone

    Posting huge blocks of text like that wont win you many friends on here.

    Split it up into smaller easier to read sections. To be honest I cant be bothered to read all of that in one go and I suspect many other posters will be the same.

    Give the dealer an opportunity to repair the car. If it's not repaired to it's "fit for purpose" sale condition then officially reject the car in writing, along with handing them the car and keys but keeping hold of any paperwork for now. I would also contact the finance company to inform them that there are problems with the car.

    As for the insurance? They'll just have to take that on the chin as they nee insurance covering the loan car.

    Unfortunately they are true.

    I started it and just gave up in despair after half a dozen lines.

    Just repost it with a few paragraphs/proper sentences and a bit less 'stream of consciousness'.

    It's worth helping people to help you.

    Oh, and, getting uppitty won't win you many friends either.

    yes the hubby had the car at work and was driving it home so that they could drop it back up at the dealer but the faults started to come on a lot more eg first time it came on the car was driveable it just went into manual mode so no biggy. But then the gearbox has started to into neutral and wont allow them any gears thats why it was going back to the dealer after his work they were just going to turn up unannounced with the car but the had the bump. hes been driving since he was 17 hes 46 now so hes a good driver. With no bumps prior to this

    Wow!!!!

    My eyes have stopped bleeding and the headache has nearly gone, so here is what I think.

    The "hubby" should not have driven the car again, after the faults with the gearbox and power steering materialised, as he was putting his and other road users lives at risk.

    He nevertheless did drive it and had two "accidents" - were they really accidents or "accidently on purpose"?

    No he really is not a "good driver", he is an absolute idiot for driving a car in that condition:mad:

    Have you (or the "hubby - good driver") ever heard of "roadside recovery" or "RAC" or "AA"?

    These are all wonderful new things which save you risking life and limb and endangering other lives.
