Well Jack I hope that whoever she hands over to is a bit more competent.
Do these solicitors really understand they are fighting your case and should be trying to get the best outcome for you.
It makes me so angry that they seem to earn their living very easily, and in the meantime trying to bankrupt their clients.
How did the viewing go on the FH?
Yes I'm with most views and disappointed that she would have known at least a month ago that she would not be handling the case up to the FDR on 12th Jan 2015. I haven't replied as I need to leave it a few days to calm down. Part of me feels like I may as well handle it myself for the advice and support I'm getting. I can make the proposal letter myself and all the admin and then pay the Barrister for the day but not sure how that will work. Really struggling to see the value I'm getting from solicitor. I'd like to ask someone more senior in their company but obviously I'd be charged at a high rate for that discussion. Guess I'll have to go down the financial services route.

Just looking in, Jack and hoping you have something pleasurable planned for this w/e, post-calm down stage.
Some of us have not got that far yet over her shameful bill-running, obviously knowing several months ago she'd not be at your side/onside come January, however defective an advocate...
Does she think 40 weeks/pregnancy is a negotiating figure?

Not sure what to do still haven’t replied, at this late stage it seems it will cost me to pull out from this firm and move to a barrister and handle any other admin myself or would I be better to let it run it’s course.
I don’t think I’ll get much say in the matter of who takes over the case as no doubt it will be based on work load at the firm, so if I’m not so keen my option will be to pull out of this firm.
There were some more people due to view the house Saturday but they cancelled?
Landlord wants me out the rental as despite rent review judging £695 is correct than can get people willing to pay £850 to I will be evicted. Despite me pointing out they didn’t follow correct procedure their solicitor wants to fight the case as obviously gets fees, so will be going to court on this one also. The agent did advise the landlord to let me stay and get rent but they have been convinced by solicitor and as they have legal insurance it won’t cost them.Regards

At one point when I reinforced this, you couldn't entertain the cost of his reading this Thread, for example...but Jack, at this point now?....
Your appalling, lax, inattentive, error-prone solicitor has behaved, it seems to me, unethically at least.
That's for sorting out later - and you must and will.

JackRS, do head over to the renting forum where people can tell you whether the S21 is legal.
If it is not, then when you get the court papers, the ndefence is - S21 not legal. Then they have to start by issuing a proepr one (2 months notice) and start all over again.If you've have not made a mistake, you've made nothing0 -

I received a packwith letters in the post Friday. Itincluded a draft letter from her solicitor requesting a new actuaries report onpensions being created using the latest up to date transfer values, the reportwould cost £1500 + VAT! To save megoing into detail explanation I’ve pasted in my email reply below, removingnames etc:
Dear R and M
I received the large pack in the post Friday but I’mconfused and frustrated by the contents:
1)Form E enclosed
This is my form E as submitted last year, I don’tunderstand the value and purpose of paying postage of all these papers that Ialready have, surely this was a mistake and one that I don’t believe I shouldpay fees on, so please don’t charge me.
2)Your letter ref.....
i) In this you say that you have attached acopy a form E received from ex Mrs JackRS? So she sent you a copy of myprevious form E and you’ve posted it to me, what is the purpose? Ialready have that.
ii) You refer to an attached letter whereyou set out transferring my files to M, I assume you are referring to the emailyou sent last week as there was no attached letter.
iii) You suggest contacting M for furtherinstruction as to obtaining an updated valuation of my pension? Iunderstood from your previous comments that it should be based on the value aroundthe time of separation, which is the one previously submitted with last yearsform E. Otherwise they can keep putting in delays to maximise the pensionvalues. So please confirm it is appropriate to use the transfer valuefrom last year.
iv) In terms of making an alternativeproposal I would suggest as mentioned previously to make option 1 our stake inthe ground, please make the proposal around these details below I’ve adjust theexplanation of house sale asset to incorporate selling fees and show 2 examplesto illustrate. This needs to emphasize that this large cash offset of theassets is a considerable compromise and puts me at a disadvantage and thereforeher maintenance requests is unreasonable considering this.
Option 1a. 70% of House sale (less agency and solicitor fees) e.g.if £300K (-£5K fees) ex Mrs JackRS receives £206.5K, if £290K (-£5K fees)then ex Mrs JackRS receives £199.5KI. Assumes manage own debtsII. Assumes no pension shareIII. JackRS receives 30% e.g. if £300K (-£5K fees) JackRSreceives £88.5K, if £290K (-£5K fees) then JackRS receives £85.5Kb. CSA £650/m until June 2015c. Lease car provided 1800miles July 2015 (value £185/m)d. Clean break
3) Letter from ex Mrs JackRS solicitor
a) I do not understand why we need a latesttransfer value as I mentioned previously this is based on what you informed meshould be value at time of separation so exists.
b) In terms of state pension the sameapplies and I am not willing to pay another £200 for this
c) In terms of the cost of actuaries reportthis I assume will be shared equally and payment terms agreed as I do not havesufficient funds to pay this fee in one payment.Regards
