    in light of recent events, im in the middle of compiling my court bundle before i start proceedings, i seek to retreive a copy of my origional contract with barclaycard. Does this come under the DPA and how would i best go about it, will it take 40 days ( or 70 days a complaint to the ICO and a threaten to take to court as it took me to get my statements ).

    also, what other info can this site provide me to put into my court bundle against barclaycard?

    Can anyone tell me how I get Halifax's Terms & Conditions for my account.

    The bloke who lost his claim with Lloyds TSB didn't have these thats why his claim failed (apparently). I've just filed MCOL and want to obtain these as I want to be prepared if I gotta prepare a court bundle. HEELLLLPPPP

    It's been ten days and I haven't received my old T&Cs from the bank. Does anyone know if the 40 day Data Protection Act deadline applies to this? As I said before, at least if they don't send it to me I can point out in court that I have asked for the relevant information so that I can build my case. Maybe I should have sent the request to Cobbetts solicitors.

    No it doesn't.

    The 8 week FO deadline does though as you would have a bona fide complaint.

    You certainly should make a formal request from Cobbetts if only to demonstrate to the judge that you asked and they failed to supply it.

    I can't see how. Its not personal data.

    Thanks chaps, I'll forward my request to Cobbetts also, taking note of the earlier indicator in this thread about the difference between "unlawful" and "illegal".

    Should I point out to the court that I have requested the information at this stage (I have sent the CPR 18 refusal letter and I'm waiting for a hearing date) or should I just raise it at the hearing if I don't get the information in time? Am I even entitled to the information as I didn't cooperate with their CPR 18 request?

    I'm slightly concerned about how asking for old T&Cs might be perceived. I mean, how can I be reclaiming these charges as unlawful if it's clear that I don't have the old T&Cs and don't really know what they say?

    All help is greatly appreciated and if I get the Natwest T&Cs I'll make them available on this board as I'm sure they would be useful to many people.
