    I'm not sure. Don't forget that we are taking the banks to court so I expect that they are innocent until proven guilty. I would have thought it is our job to prove that they are guilty.

    That archive site is good but I've yet to find anything useful on Natwest.

    Its a hearing, not a trial - No-one will be found innocent or guilty. You both argue your side of the case, but the judge will expect you to back this up with some form of evidence.
    The acquisition of wealth is no longer the driving force in my life. :)

    I've just tried to look up abbey but getting a message that the website declined to show this webpage!!! Any ideas where else I can look?

    if the bank relies on t&c's in their defence they need to present these in their defence bundle. alternatively, data protection act request for a copy of the original t&c's, or to be awkward, just use it to ask for ALL information they have on you. that way you see everything for £10.00

    also, ive noticed that on the back of statements for c/cards, charges are in one specific box and overlimit/late payment fee's are in a seperate box headed "default".

    also, the "service" provided is actually a dis-service to the customer as it imposes a greater penalty than the actual cost of the breach. the bank has the power to deny the breach, but for financial gain chooses to allow it. That is the argument.

    I have found this for HSBC 2002, but nothing happens for me when i click on the link.

    Can someone please let me know if this works for them, or where i can get the T&C's from HSBC. My claim is between 2000 - 2005.

    I don't have mine for my Nationwide flex account which I have held for 10 years. However if I log on to their current site they have their charges listed as such:

    Unauthorised OD charge £20
    Charge for unpaid item (DD, SO, chq) £30

    Is the keyword charge as opposed to if it was called a fee?
