Void warranty due to water damage...

    I have been trying this, it's not getting me anywhere.

    Sony have told me to take it up with PC World as unfit for purpose. I'm not claiming it's not waterproof. They are saying it has water in it, therefore there must be some ingress somewhere. There are various IP ratings, I'm not stating that this machine should be rated IP68, but it should be at least IP54, and as it hasn't been subjected to any conditions that would surpass an IP54 rating, therefore it must be unfit for purpose.

    Here is an excerpt from my letter:

    The Sale of Goods act 1979 states that goods must be as described,of satisfactory quality and fit for purpose. Fit for purpose means both their every day use and any specific purpose. Satisfactory quality means: fit for purpose, satisfactory appearance and finish, free from minor defects, be safe to use and last for a reasonable length of time in a reasonable condition.
    Further, under Sale of Goods Act in the first six months from when you purchase something the onus is on the seller to prove it was of satisfactory quality when you received it. If the seller simply says the problem must be due to something you've done, it's for them to prove that. Under the Sale of Goods Act if something is not of satisfactory quality I have the right to a refund.

    Get on to the head office for Sony UK, and insist on speaking to someone high up in customer services. I've done this before after someone in CS was very rude to me. The manager at Sony HQ listened to the call, and then apologised and gave a brand new replacement with loads of freebies. And I'm not a free loader who tries it on. All I wanted was a repair.

    Yes I do know about SoGA.

    What you don't know is how much moisture there is inside it, or how it got there.

    I think it is time to contact Trading Standards.

    Another update. I *never* get any response from Sony. PC World keep saying the same thing. I just called my credit card company (Lloyds TSB), told them the whole story, the guy on the phone told me not to worry and that they will have my money back in 2 - 3 weeks. He seemed 100% positive. So, now I know, should have called them first. Anyway, feel much less stressed now. Will let you know in 2 - 3 weeks if his confidence was correct. Fingers crossed!

    Are they looking to refund the whole amount of the laptop?

    Have you even got the laptop back?

    I would still tell Trading Standards and Watchdog about this though, as it is all evidence against PC World and Sony.

    @Lifeforms. Talking to the guy at Lloyds he seemed confident that they would just refund the whole amount for the laptop and that I needn't get the laptop back. He did mention that they have quite a lot of dealings with PC World.

    @Jamie Carter. Thanks. Yes, definitely, when this gets refunded (here's hoping), I will pursue a follow up with Trading Standards, and also will find out how I can pursue a legal claim against PC World as I believe they have been criminally negligent in this case.

    Anyway, first things first, hopefully I will get some good news in a few weeks time.

    Please do continue to let us know what happens. hopefully they will just do a full refund, but perhaps don't go sony or PC world as a replacement!

    Logistically who can do things like take photos of the innards to show things like water sensors are not breached as part of sending in for a repair. Usually opening it up under the warranty period will breach it anyway, and outside warranty you wouldn't be sending it back that way. Seems quite unfair, and it happens to a lot of people over a range of electronics.

    Also a few laptops over the year have come to us freezing cold and condensationy and it said in the documents allow to warm to room temp first. Perhaps it's a failure from the start with the sensors.

    Not just laptops.
    I remember reading that advice in old TV and VCR manuals.

    It's one of the reasons I always try to give any electrical appliance that has been delivered on a cold day a few hours to warm up before installing it.

    I'm not sure exactly how this would work, but I'm sure you would have data on the hard drive. So there must be a way that you can get the hard drive back.

    You bought it from PCW, you took it back there for repair. Send PCW head office registered letter demanding return or repair within a reasonable timeframe, say the same amount of time it took for them to initially get back to you. Demand to know what the actual fault is. 'water damage' does not quantify/justify a fault description, it is an opinion, nor justify them quoting a price to fix. Then go to small claims court, as stated in your letter after prescribed time, when they don't turn up to challenge you in court, you will get your money.

    You didn't buy the lappy from Lloyds, don't hang it on them. You didn't buy directly from Sony, you don't need to deal with them.

    If PCW won't/don't return the lappy then they have effectively stolen it, including any personal/work related information stored on it, and you will be seeking further compensation, if the matter isn't resolved for loss of earnings etc that has resulted in them not returning/fixing it. Also, possibly find out the CEO/head honcho at PCW, and cc them the letter, their details are listed with Companies House. *edit That would be Samuel Chamberlain
