    The problem is that the majority of people who receive these fake "fines" pay up. It's actually a bit of a grey area on getting RK details from the DVLA. Anyone can apply on a form V888 pay £2.50 & get the RK details by saying that the vehicle scratched your car in a car park or that it's been dumped on your land or any other perfectly legitimate reason to need to trace the RK. However Private Parking Companies are specifically excluded unless they are members of the British Parking Association Authorised Operators Scheme. Once BPA AOS members have passed a probationary period of submitting manual requests they can get RK details instantly & electronically direct from the DVLA. If a dodgy PPC not a member of the BPA gets RK details by applying manually even if they ever get found out they will apologise & say they were just doing it on behalf of the landowner.

    it looks like OP got a ticket on car, then replied in writing giving her address and then got a reply back. Unless, of course, it was all done by email.

    If former case, then they have got the address legally. (and no DVLA fee !)

    Parked in forecourt of Argos and Homebase to shop. Have a valid disabled badge so parked in a disabled bay. Told my husband to put badge on view and went to Homebase. Husband who is 81 and forgetful forgot to put badge out. Returned to car 10 minutes later to find ticket on car from LCS stating car parked illegally as no badge showing fine of £85 if pay within a certain time or £120 if time runs out. Appealed with letter stating mitigating cIrcumstances and photocopies of disabled badge (have I shot myself in the foot here). Reply states I parked illegally pay fine of £85 now or risk paying £120. Googled what to do next and read about Parking Ticket Tribunal as next appeal stage. Rang company up and was told I could not re-appeal as they are a private company and there ARE NO GROUNDS FOR DOING THIS help!!!!

    Would this not be a case for one of your disability letters? The point being that POPLA is out, but a letter along the lines of

    Blue Badges are not applicable on private land. I understand why you may have issued a ticket, but now that you have been informed of my disability, you are required to take notice of this and cancel the charge. Your operative should have been trained to see that my car has a Disabiilty Road Fund Licence stating Disables and with zero road tax.

    To continue to pursue your claim puts you in breach of the Equality Act of 2010. Should you continue to do so, I will defend any action vigorously and counter claim for £500 compensation as a breach of the Equality Act 2010.


    I am sure c-m could improve this draft, but I do fear that doing nothing may worry OP and husband with all the scamagrams that will follow.
  • I have read all the advice and realise that the mistake I made was assuming it was an ordinary Parking Notice and that if I appealed and sent evidence, they would smack me over the knuckles and let me off. The worst thing I could have done was write in and then phone them as well. How stupid I was. I know that if I am ever silly enough to do this again I will just ignore it as there is nothing they can really do without driver details. However I now either have to pay up or face a barrage of nasty letters and phone calls. They know I am a blue badge holder but they ignored this. Drivers beware ignore all tickets issued by LCS or you end up stitched up like me

    Guy's Dad is right, there is a third option of sending a Letter Before Action to the parking firm and to the retail park management. Like this:

    Another poster recently got hundreds of pounds in compensation for this illegal harassment (similar to your case) because not displaying a Blue Badge which ONLY applies in Council streets, doesn't take away the disability need. So to continue to harass a disabled person and not to make 'reasonable adjustments' for them (never mind the Blue Badge) is illegal.

    Maybe start by complaining in Argos and Homebase and when they say 'we didn't instruct the paring company' then ask who did as you want to 'complain'. Then is fact send a Letter before Action (a threat of Court).

    Look at the linked threads; blossom1948 and caryl2506 were both newbies here but quickly understood the issues - and blossom1948 has an offer of a refund now (she stupidly paid!) and caryl2506 got the fake PCN cancelled and an apology from the retail park (she Googled to find out who owned the place).

    Don't beat yourself up. They may have had some cause to issue a ticket in the first place - at least by their rules -but the minute they are made aware of your disability, they have to back off.

    Just do as we suggest and whatever, do not pay.

Didn't like the thought of nasty letters and phone calls so did vaguely think of paying coward that I am but then decided to try and do something particularly as the rest of the Parking area is free (the Homebase Manager told me this) .I contacted the land owners Henderson Global Enterprises and left various messages no call back yet Contacted Manager of Homebase as mentioned before who was very helpful but said I should speak to Managing Agents Savill Commercial. I am sure that under 2010 Equal Opportunities Act if parking elsewhere is free that I can do something. The Manager of Homebase does however dispute that on private parking areas the stipulation of the showing of the blue badge is not applicable . Can someone give me the relevant legislation.     Why don't you just do as I suggested above and send a version of my draft letter to the PPC.

    Tell them that under the Equality Act of 2010, that reasonable adjustments have to be made for disabled drivers and passengers, but there is no requirement under the legislation referring to blue badges. http://www.legislation.gov.uk/ukpga/2010/15/section/20

    I take it that your car has a zero tax disc? If so, then send a copy of that as well indicating that this showed the driver to be disabled and that there is nothing in law that enforces a disabled driver to have a blue badge. Also, any disabled driver from overseas visiting this country has the same rights as any UK national as far as Equality is concerned and to demand a blue badge racially discriminates against non-UK residents and that you will use this argument should it come to court.

    Their staff should be trained to look out for disabled road fund licences.

    You may also wish to look at the thread on here where another MSE member has sent the PPC an LBA claiming £250 under the legislation.
