Bought new clothing and it was nicked in the carpark

    I can see why they can't refund me now.
    Because it is 100% your own fault, not ifs, not buts.

    Though imho, they should have not replaced the wine as its was the shopper's stupidity. He was one of those customers that shoves £40 of shopping into 2 carrier bags type.
    Asda provided the bags, they share the responsibility, it doesn't matter how much he put in the bags, that is the size Asda provide, he was entitled to put is as much as would fit, Asda chose to supply a flimsy bag. :wall:

    Don't supermarket car parks have signs stating that they are not laible for anything that happens to your car or belongings in their car park? You took the items out of the store, they're your belongings... Asda aren't liable.

    If this is a real post and I were the OP, I'd definitely be thinking that the friend is to blame. With two people facing each other whilst talking, one HAS to have seen something. If the friend didn't notice, I'd expect that they're the one to have taken the bag.

    The signs say that Asda don't accept liability for loss or damage of property. The wine was purchased and now the owner is the customer. The bag that breaks also smashes one or two of the bottles. That property is damaged so Asda should not gave the customer those replacement(s).

    This made me laugh, how can you even dream to have the cheek to go in and ask for a refund or replacement? I'm as skint as anything at the moment and I wouldn't even dream of doing such a thing!!! You were responsible, learn your lesson and watch your belongings next time!

    But you're missing the point. Asda could potentially be held liable in this instance because they supplied the method of carrying. (Which, it could be argued, wasn't fit for purpose.)

    If someone steals your car for example, lets say you have a Ford... would you then go to the Ford dealership and say 'My car has been stolen, I got it from you, I would like another one as a replacement please'... what do you think they would say?

    I dont mean to be mean with this post, but it seems madness to think you believe you have been wronged in some way.

    Are you saying the bag they provided you to put your new clothing in wasn't fit for purpose and it was the fault of the bag that the clothes were taken? :p

    I wonder how they kept a straight face when you asked them for more items that will cost them because of your own stupidity.

    I have phoned Asda and they will check the CCTV cameras in the car park and they will check.

    If they cannot find footage of the stealing, then I take it on the chin and accept I have lost £8.

    Horseunderwater, I did mention the bottle of wine situation to the person I spoke on the CSD and they said that the cashiers are only allowed to put in two bottles of wine per carrier bag, so its the customer's stupidity, not Asda's. Though it was my stupidity for not putting my carrier bag with the item of clothing underneath the shopping or inside another bag, I lose out.

    this is a wind up isnt it?
