  • Have just looked in to say hello to some old friends and to see how everyone was. It has taken me well over an hour to catch up because like some on here I have not been reading the thread every day (or even every week recently). Trying to put debt out of my mind for a while.

    Interested to read so much about MBNA as we have reached an agreement to pay extra to them on the basis that the debt with them has been reduced by almost two thirds if we can clear it within six months. Someone mentioned ages ago if that would be sen in a bad light by other creditors. The ans. is no because 1. They won't know until we have cleared it off and 2. Their payments (through Payplan) will then rise which will be to their advantage.

    Sorry I am not around so much now but I am happier not reading about debt every day. This is a brilliant site and I will say to all new people that it does get easier. Ph. calls do stop. Computer generated letters can be ignored, normally. I still get them from MBNA for example but was told to ignore them by staff who incidentally I have found to be very helpful. So it does get better and you do feel that progress is being made to get your life back onto an even keel. I hope that helps some of you.

    Will check in a day or two for any replies from anyone who cares to respond such as my old friends YM, ILGD, Armani, Newleywed, Crafting Queen, etc., etc.

    Just a quickie as I am doing tea.

    Found out the other day that I am on an Early shift on Xmas day starting at 06:30 :mad: . Hey ho no work no money I suppose.

    Crikey this thread was way back on page 9!! and since all the problems it seems to have disappeared from my User CP info..

    Anyhow I was just wondering if any of you have had any success with the following:

    I have today been issued with County Court papers re one of my debts and when I look at the information contained there the default balance they've given is incorrect and doesn't include any payments I have been sending them through CCCS

    and.... the collection charge is not representative of the amount - over £1000.000 :eek:

    I am today going to return the acknowledgement of service part of the form and include a letter stating that I intend to defend part of the claim - 1 of which being the outstanding balance, and the other being the collection charge.

    What do you think my chances are? :rolleyes:

    Never dealt with anything like that before but if the balances are not right then something is wrong. Is it with a debt collection agency or the original creditor?

    You definately have to stick up for yourself and argue your toss!

    Have you spoken to CCCS see what they say about it too?

    Well I believe that the debt is still with the original creditor although they have instructed their solicitors.

    I have spoken with the original creditor today, who can't understand why the solicitor has applied for a CCJ as I advised that I will be able to increase payments within the next 6 months and that the payment offer is quite good anyway.

    They were also unable to provide me with the outstanding balance and that I had to speak with the solicitors for this - so at the moment I'm not sure who the debt is with - however I am continuing to make my payments to the original creditor and we'll see what happens.

    I have spoken with CCCS who have suggested I needed to defend part of the claim which includes the collection charges so I'm interested to hear if anyone else has managed to do this.

    Also... has anyone ever had the threat of CCJ removed and it never got to court stage?

    Lloyds sent me a solicitors letter once but not a court order and I sent a formal complaint into Lloyds and never heard from the solicitors again and payment was accepted.

    Does sound very confusing because if it is with the original collectors they are the ones that instruct solicitors - strange!

    Sorry I can't help I know a few people in here have had CCJs etc so hopefully they can come along.
  • Well its all happening today!! I've also received a final demand from HSBC for my Credit Card at least this might now get passed on to debt collection and interest being stopped!!!!

    Hi everyone nice to see my old pals on here again ILGD, RAY, YM, DR J and all the new posters, you are in the right place.

    SCARED Glad that you did not find the court too hard. Did you find someone to look after your daughter?

    We have been on a DMP with CCCs for 8 months now, its the best thing we have done and it does get better.

    We have a CC with VIRGIN and MBNA we have received a letter from them both today saying "As a result of your continued payments by your due date, we have restructured your account. We have cleared your arrears and the credit reference agencies will be informed that your account is now up to date.

    HELIFAX have also stopped their constant calling!
