  • I am about to send the letter to my bank which is Halifax PLC detailing the charges and the amount I want to recliam.

Can someone please advise me where do I send the claim letter too?
  • Can I just say, has anyone noticed how many reclaimations are being made with the Halifax, does it have something to do with how profit greedy they are and how bad their customer service is?????? I must say I have not come across ANYONE who has had a good thing to say about the Halifax, good job they are being taken over.
  • yes ive noticed that too and ive sent them a letter myself for charging me £39 three times for going overdrawn aswell so hopefully theyll give me back the money without any hassle ill just have to wait and see what they have to say! never been through the court process before so worried about that bit if they dont give in easily but will fight untill i get back my £117 back

  • hi all,
claiming off halifax was told yesterday they accepted i was in financial hardship. Then was told they would contact me can someone tell me if this has happened to them and what happens next because after 18 months i thought i was getting somewhere and they just seem to be shifting my claim from one department to next they lost my initial claim and forms i filled in 7 weeks ago done them again since any info will be good should i keep pestering them as if i did not ring them i still would know nothing as they have never contacted me only to say that about the test case was on and all claims were on hold HELP !!
  • Cashcarlos if they have verified your hardship then you should get an offer soon. What they do now is request a full list of charges from another department. These take around 24 hours to come back and then it really depends how many cases they have on the desk. I have had 3 such claims with the Halifax all of which have been paid in full - 2 of which had about £300 more than I expected. I would let it sit until next Tuesday/Wednesday and give them a call.

They will pay any refunds into any debts held with them though so be aware of that.

I have found the Customer Relations people to be really nice. The number you can use rather than the expensive 08 number is 01977627358.

    Good luck.
  • thanks for the advice will bare that in mind ex spendaholic,
    thanks for the reply
can any one tell me if a debt is over 6 years old can they take it back.:rotfl:
  • I'm not the best person to answer that one but pop over to Debt Free Wannabe and someone can tell you.

As far as I know if a debt has been lying dormant for 6 years and they haven't chased you and you haven't made any payments then they cannot enforce it. I could be totally wrong though.

They also lost my common financial statement. i thought; to save time i would send my own budget sheet. But a few weeks later they asked me to fill in there own CFS. After hearing nothing from them for a few weeks i called them and was told they had LOST it. Said they would send me another one. I told them not to bother as they already had my details on my own budget sheet and i will be informing the ICO under the Data Protection Act that they had lost my personal details and financail details. Next day they agreed to use details from my budget sheet. mmm....i wonder why??

Then they kept moving the goal posts telling me a few weeks, then by the 28th then said they dont give guide lines. so i filled in an N1 claim form from county court and sent them a copy telling them they had 7 days to settle or i would submit the form to the court. Heypresto...on the 6th day they sent i letter to settle out of court.

Halifax are awful. you really have to nag and fight them, but they will crumble in the end.

    Good luck:beer:

I'm no expert in things really but i do have 36 years of experience in life, and some of those years fighting off bailiffs.
Nicknamed Victor Meldrew among friends as i love to complain;)
  • after seniding off a letter to halifax asking for the charges back they replied saying " we believe these charges are fair, transparent and lawfull....
it would be our normal aproach to resolve your complaint through our internal complaints process as quickly as possible. However, untill the determination of the legal issues in the above proceedings, we ave asked the FSA to suspend the normal timetable for dealing with unarranged overdraft bank charges complaints, and the FSA has agreed to this request subject to conditions that protect your rights.
You have stated that the charges have been deducted form your social security benefits. We do not believe the social security administration act 1992 prevents a bank from applying charges to a customers acount when they have insifficiant funds to cover a payment they have asked us to make".
so now they have sent me a MAT/BBA Common Financial Statement to fill in with my details, this seems like a dead end to me what to do now???
any help would be very much appreciated
