Reclaim Unfair Bank Charges article discussion Part II

I recieved a letter back this morning after filling out claim form etc and in the letter the bank advise that in no way do they accept that they are in the wrong but as a good will gesture they have enclosed a cheque for £1040.
Now I have a dilemma do I write back and ask for a fgure a bit closer or do I accept that it's £1040 that I thought had gone???
I just feel a little disappointed
Any advice would be gratefully receieved

I'm trying to work out what I can try to reclaim. I've pain-stakingly gone through my statements online for the last 6 years and only have the following category types from my statement (Lloyds TSB) for bank charges to go on:
Account Charge
Cash Charge
Credit Card Service
Overdraft interest
Overseas Transactions
Can anyone help identify if these are claimable or not?

Hi All,
I have submitted two claims to recoup bank charge fees, one with Lloyds and one with Halifax. Both banks have said they won't repay anything and I have had a final response from both confirming this. Both cases have then been submitted to the Ombudsman, with the Lloyds TSB one still with them, but the response to the Halifax claim is as follows:-
As you may know many consumers have complained about the level of a charge on the basis that they believe them to be legally unenforceable for various reasons and excessive.The Office of Fair Trading has been considering these charges for some time and has now brought legal proceedings in the High Court to decide the issues of law that are raised in these complaints.The law is one of the things we are required to take into account when we make decisions about cases, and the proceedings are intended to clarify the law. So, after careful consideration, we have decided that we will await the outcome of the court proceedings and will not investigate bank charges complaints at this time.You should contact the firm yourself and ask for your claim for bank charges to be recorded. When the legal proceedings are concluded, the bank should write to you about your complaint. If it remains unresolved after that you will be able to bring it to us.Yours sincerely,J

HMMM A & L Seem to have invented a new charge!
Payment review fee!
A charge of £25 too see if they should pay a transaction!
Even if its returned!!!
OR They get the double or even treble whammy of the returned dd,chq (£25-35) then possible unauthorised overdraft (£25) PLUS this so called "payment review fee"

Can anyone out there update me on this test case?
It's been 2 months now since the judge finished hearing the evidence. How long do these things normally take for the judge to decide? I know it's been said that a decision will be made by latest end of july but that's like 5 months. What do these judges do all this time? If he were to ask me I could give him some very good advice....0 -

The banks are obliged to tell you to contact the FO as you are making a complaint but the FO are no longer handling bank charges complaints in the way they did when they would actually pursue your case for you instead of taking the court route. Have a read of Martin's article here...

You'll find a list in the Reclaim Help Thread which is linked in my signature and check the Lloyds thread but at a rough guess the answer is probably no to all of them. Certainly no to Overdraft Interest, Overseas Transactions, Cash Charge is this for using an ATM that charges? If so then no. Account Charge, do you have an account that has a monthly charge for some benefits? If so then no and as for Credit Card Service I've no idea, check with your bank what its for.0 -

As they have sent you a cheque you can write back and say thank you for the Goodwill Gesture but that you will be continuing with your claim via the FO as a hardship case for the remainder.0 -
I think it is very difficult to know what to do in those cirmcumstances, In my case I claimed £1.091. in JANUARY 2007 and when they offered me £705. I did write back using the wording advised on here saying that I accept the offer in partial payment only and require them to pay the full amount as I will pursue the whole amount in court if they do not.( I think Edinburghlass is the one to advise you on this) Well I got nothing and no reply either, so I took it to court, My case was stayed in August I appealed against the stay and requested a hearing to uplift the stay, went to court and lost the appeal to uplift, Now I have followed the OFT case and nothing is happening until at least JULY, it is so depressing at the moment. I have often thought I wish I had accepted the offer, but it was the principle of the thing.

I know its been particularly frustrating for you Agnes to have got so near and yet so far but as leedslass has actually been sent a cheque rather than just an offer she can of course accept this and write to say she will continue. As the bank seem to have accepted the case as a hardship case then the case should be able to be referred to the FO.0 -
Hi this is my fisrt thread ithink thats what you call it. I claimed £200 off of my studio cat couldn't belive it took a template off of this website re arranged a few things and two weeks later that sent a letter saying as a good will gesture they will pay the £200. Hummmmmmmm wasn't gonna compalin but still thought it was a bit checky as if they a doing me a favour when its them thats in the wrong for charging so much. Sorry for the long message. So my advice to anyone keep pushing .0
