Hello there i m a bit confused, i got my statement of charges from my bank but i m not too sure what the next step is, can you help me ??
Regards Ant
If you click on reclaim £1,000s on this website it takes you through step by step. It also has links to templates to use.
Your next step is to calculate the amount they owe, with interest (or without - your choice). Again this is on this website to help you.
Then send your first letter, await response below:
1. No response (14 days) - send 2nd letter (templates)
2. Response saying on hold re OFT court case - send 2nd letter (response)
3. Rejection - send 2nd letter.
In short, whatever the response send your 2nd and 3rd letters and then register in court. By registering in court, even though on hold, this means that your claim dates (if pushing the 6 year boundary) will still be valid. Also if it does go to appeal, and the courts hold action pending appeal, even if it takes 5 years, your claim will still be valid. Without being pending in the court, the claim date of 6 years continues to move forward (so if it is 5 years to appeal, you may only have 1 year of claims left) so it is worth the risk.0 -
I have sent off my 'Second Letter' asking for my charges back and I recieved a reply explaining that all the claims were on hold until the end of this OFT case.
OK
The charges I'm claiming equal £2701 and my Current Account with HSBC isn't looking good at the minute because of all these charges. The only way i'd be able to get that Account back to £0 is if I get these charges back...
Should I send HSBC another letter asking that if they're putting my complaint on hold then could they then 'freeze' my account from any money going in or out of it?
Do you think they'll do that? And if they say no, is there anything I can come back with legally?
Ben
Benny Im interested to know whether you asked your bank to freeze your account and what their response was and whether there was any reprecussions. I think it's a fair suggestion to make considering they have put on hold dealing with your reclaim. If they do agree it would also mean that your not incurring any interest or default charges and that way you could save towards clearing off the balance at o% interest. (Im not sure whether they would agree to such a thing though, but its worth enquring in the first instance.)
I hope anyway that do find a plan B option to reducing your HSBC account and not just relaying on the outcome of the court case.0 -

You need to read Martin's article here...
http://www.moneysavingexpert.com/reclaim/bank-charges
and the Reclaim Help thread which is here...(post 11 gives you a start guide)
http://forums.moneysavingexpert.com/showthread.html?t=400981
You don't send your statements anywhere but make a list and use the Interest Calculator to work out the amounts, you'll find this in Martin's article as per the link above.0 -
Sorry if anyone has put this in recently, but does anyone have a blind clue about what is going on with the OFT regarding the bank charges. when will they give a decision or anything please.
Sorry about this, have just found this link after a couple of days of searching... finally, not brilliant news though.

I started claims against 3 banks last year, but all of them put my claims on hold due to the test case. They have continued to charge me since, so my question is, can I put in an additional claim even tho the original claim is now more than 6 years old?

Congratulations to you pete0773. :j I am claiming from HBOS as well. Just about to put in a claim at the local county court. Did you also claim for interest on your bank charges?0

Hi
This is my 1st post on here so please bear with me if I am in the worng place.
I have been unemployed for about 4 months now so contacted the Yorkshire Bank re my bank charges £6105 in total and claimed hardship as I am paying out more thanks to family than I am earning on jobseekers allowance.
I recieved a letter back this morning after filling out claim form etc and in the letter the bank advise that in no way do they accept that they are in the wrong but as a good will gesture they have enclosed a cheque for £1040.
Now I have a dilemma do I write back and ask for a fgure a bit closer or do I accept that it's £1040 that I thought had gone???
I just feel a little disappointed
Any advice would be gratefully receieved

pregnantmum wrote: »hi thanks for your reply, I am hoping they will settle at this as to be honest I am six months pregnant and am struggling financially after losing my job at Christmas as well, so I could do without the hassle of going through courts etc but am determined to fight this as this amount of money is no way justified, and also I have had fraud on my account 2 times in the past year and even though I pay identity theft insurance etc, when fraud happens there is nothing they can do and have been left in the toilet so to speak.
I set up a 'parachute' accout with another bank before I sent my letter off though as I heard they may close your account for requesting charges back. I have asked for £5995.50 as settlement instead of the full amount, I have not asked for interest either, if I did this would total to £12,000+!!!! But have forewarned them I will request this if it goes to court plus legal expenses.
I sent my letter to request information on charges to the head office, then my request letter to have them back to my local branch, which I sent recorded delivery, so they couldn't say it wasn't received. It took them less than a week to reply to say about waiting for the legal case to close to see where they stood etc, and that if I was to go to court they would apply for a 'stay' on it until everything had been completed with the OFT. It's not deterred me in the slightest and I hope you get some luck with them :-)
I just need to know where to go if they reject the offer, as I wouldn't be considered for small claims and going through the other channels could take months etc. And in all honesty I won't settle for less than my offer as I think they are getting a good enough reduction considering.
Hi there,
I today received my list of charges (it took about 20 days in all), and was very surprised to see just the top letter, and then just one sheet enclosed, in the form of an internet printout, with my 6 years charges on it! is this right?? I guess I was under the impression from reading previous posts on here that some people claiming were sent like dossiers whereby they had to total charges (not incl Interest) themselves? mine were listed on this page, then totalled at the bottom.. strange, but if this is how it's meant to be, then fine..
In any case, i was surprised to see that mine totalled just over £3000 from 2001 - 2007, but there was nothing included so far for 2008, and I know for a fact and have the proof that I have had a few more charges since the turn of the year.
I guess I should just crack on now and send off the letter now asking for the charges back? to local branch? obviously then comes the wait while the OFT test case is reaching it's verdict.
How is your case progressing? any other guidance would be appreciated, thanks.0
