I thought the banks could no longer charge excessive charges I've been charged £39.00 twice by halifax this past month for what should have been an £11.00 payment. ugggh!0

I came across a good tactic to use when fighting authority, it's called the '100 letters-a-week' system.
It works like this, If you write to your MP (or direct to a specific Minister) they are obliged to log the receipt of the letter & send out a reply. If a big enough group of people each sends 1 letter per group member per week to a given Minister (in this case, Alistair Darling), then pretty soon he will cave-in under the weight of mail & start to listen.Never Knowingly Understood.

Hi All
I am due to emigrate to Australia at the end of January. I have 2 claims ongoing against the HSBC (one through mcol & one at thre requesting back by letter stage) and was wondering whether anyone has any idea of when the test case will be decided as obviously I am hoping to get my money back before we leave the UK

Help - i wrote to HSBC, they have replied and everything but now they are telling me i have to wait until the Court date....is this right or are they trying to fob me off......shall i wait or shall i send them the next stage of my battle - the court .....

It will certainly not be over by the end of January.
My personal feeling is that there will not be a trial at all. Firstly, the negative PR will make it too costly. Secondly, there is no way that the bankers will allow their true costs to be revealed to the world and show just how much they have been ripping people off and LYING in their written defences that they have submitted in thousands of claims..
I expect that a deal will be done before a trial goes ahead, or certainly before any trial gets to the point where the bankers are forced to reveal their actual costs. Perhaps cap will be introduced pretty much the same deal as with credit card charges, maybe a slightly lower figure and the whole reclaiming thing starts all over except with far fewer people making claims.
The OFT will claim to be our champions by making a deal that suits everyone and the bankers will start a PR campaign about how they have done us all a favour.
The consumers/victims will not be given a second thought or any chance of having a say as usual.0 -
hiya all, i have just come acroos this site i wasn't aware that i could reclaim my charges back. i was in the army for 4 years 6 months, all the time whilst i was in the army i think i averaged about £120 a month i've worked it out and that comes to £6400 alone without any interest, i've just sent the first stage of the process one thing that i'm a bit unsure about is that i dont know wheather to claim for the interest back i think it could be close to 8-9k could i please have a few peoples opinion on this please as it would give the confidence to go ahead with the interest charges as well. another thing is that i have recently just had to take another loan out to repay my old bank back. the reason is that this bank was threatening me with collection agencys coming to my door i was so worried about them taking my car. please coould anyone give me a bit of advise it would be much appriated thanx alot gaz0

Firstly, if the bank you had to repay was the one who levied the charges and they sent a debt collectors to your door for a debt that was made up from unlawful penalty charges, you could answer them as in the following post:

The small claims track has a limit of £5,000 (before S.69 8% interest). Many people split their claims into 2 parts to keep within this limit. However, about a year or so ago in Scotland, Clydesdale won a plea that the claimant was abusing the court process by splitting the claim (small claims limit is only £750 there) and the claimant became liable for costs.
When you go out of the small claims track for a claim over £5,000, you become liable for the other party's costs should you lose. However, the chances of losing are pretty much nil as long as you prepare yourself properly & take the time to understand what you are doing.
Furthermore, many people have been successful in pursuading a court to allocate larger claims like yours to the small claims track given that this type of claim is straight forward and has been done thousands of times on a regular basis.0 -
Hi everyone.
I am a student at the minute, in my second year. After leaving college and going into a job I racked up numerous bank charges and credit charges as I am sure most other people have done. back then I thought nothing of it (other than being annoyed that is, but what could I do but pay?)
After 8 or so years of accumulating these charges, Barclays must owe me a small fortune (both on my current account and my Barclaycard) and I am wondering what to do.
Financially I am broke at the minute, studying full-time and unemployed I am relying on my mum (who isn't exactly well off) for money until my next installment of my student loan comes in January.
Is it worth me sending this letter off to Barclays now? Will they reply with the current state of affairs awaiting the outcome of this hearing in January? I really could use the money as I have nowhere else to turn at the minute and hate having to ask my mum for help and with the stress of university too it is getting a little too much to handle.
Also about 5 years ago I took out a Capital One credit card with a limit of £200. After doing so and using the limit I lost my job and they kept charging me charges until the total reached £900! They passed it onto a debt recovery agency and now they say I owe them £900+. A while back I had a little extra money and said I would offer them £400 to clear the debt, which I thought was very reasonable as they were getting 100% profit really on money I borrowed but they refused. Would they be legally bound to reimburse those charges back onto the amount?

Hi All,
Am after a little advice with my claim, if anyone can help.
I've followed the advice on the site and received a 'get stuffed' letter back from Barclays - I'm trying to get back £2500. I then sent a letter threatening court action but have received no response back from them.
I now don't know if they are ignoring me and saying 'take us to court, then' or if they are ignoring my letter because of the test case that is due.
Anyone in a similar position ? Any help and advice would be very much appreciated.
