Reclaim Unfair Bank Charges article discussion Part II

Dear All,
I was wondering what the deal is with claiming from banks that are involved with this court case in January. I'm rather confused.
In the last 5 years I have had in excess of £1200 pounds charges. And in the last while I've been very good with my cash.Until last week when I knew I wouldn't have enough to cover a dd so I phoned my manager and was told the charge would be held off, as I knew I had funds arriving in a couple of days.So you can imagine how irate I was when I got 2 £30 charges in 2 days! He is on holiday and his stand in can do nothing for me so now I have to wait till he returns0 -
I'll third that. Does anybody have any news or updates on claims made since the test case was announced?
I guess this is specifically to bank account charges rather than credit card charges because of the different rules. Would be good to know what the very latest offerings are from the banks, so any news would be useful, thanks!0 -
i sent off the bank charges letter yesterday, (halifax)...will keep you posted with updates.... i dont know why, but i have got a horrible strong feeling that they wont make it as easy for me as others have seemed to have...i hope they do, but i cant see them paying out.. just filled with negative thoughts at the mo, i think mainly this is due to how much they have been getting me down with the snowballing charges...anyway, lets hope im wrong, and good luck top all trying to claim at the mo.... i even put in a little sarky note about paying me by xmas so i wont have another ruined oneCorduroy pillows are making headlines! Back home in London now after 27years wait! Duvet know it's Christmas, not original, it's a cover.0

Hi guys. Im new to here but I have had the EXACT same instance as a lot of other posters. A bill to myslef in another account was paid twice for the same amount, same date etc (so clearly an error) and I even went into the branch that day and cleared the o/s amount. I was advised by a member of staff in front of me who wrote on my statement after agreeing with another manager at the call centre to have the 'charges waived' funnily enough they never were and luckily I had the funds sorted because they didnt tell me, they just took £25 from my account. 3months on, I had a snotty conversation over the phone where the A+L member of staff told me to 'do what I want, speak to the FSA if you want'. I know its only £25 but the principles! As with you all, I was told today 'your complaint will be on hold till we resolve the high court case, and to be honest you wont get anything back'. This is disgusting, and I would have thought as it was clearly a genuine mistake and was my first and only ever charge that I would have it waived.
Anyone had any luck with their solitary £25?!0 -

Just thought I would let anyone out there who think they are not getting anywhere with their claim know that after about 8 months our bank has finally paid out in full approx £8500 in charges.
We thought it would be harder for us in Scotland as the iaw is slightly different but we got it.
We wrote to the bank 3 times, then applied to the sheriff court for payment(£750 per claim because we are in Scotland). This was granted and the bank paid, then we applied for another £750 and the bank paid, when we applied for a third the bank said we had accepted the offer as full and final paymet(which we never) so we took it to the FO, then after acouple of months we got a letter from the FO saying the bank does not think these charges are un fair or un lawfull but to stop any investigation with the FO they agreed to pay us back the charges but they did not deduct the £1500 they had already paid us so it was win win for us. The bank was HBOS(bank of scotland).
So for anyone out there who are still trying keep going and you will win.:j
Hello kevin Congratulations on getting your money:beer: How did you get them to do this when all claims are stayed with the FSA waiver? val0 -
 Boy am i mad. For years i was told by Halifax staff that as long as money was paid into an account before 2.30pm, a direct debit would still be honoured for that day. Yesterday i had a dd due out, i knew i was £7.00 short so at 2pm i paid £10.00 into my account. I checked the account this morning to find the dd hadn't gone through. I rang the 'help' line to be told that this arrangement had ceased a few months ago. I asked if they had informed customers of this only to be told that it was a 'loose' agreement so no they hadn't informed customers. I argued that weather or not it was a 'loose' agreement, if they accepting an arrangement, then change it they should still inform customers, otherwise how are they to know.
I know i should have got the money in the day before & i did try but when i got to the city centre branch at 5.15pm after finishing work it was closed (other branches shut later). I am now going to write in to claim the £39.00!!!!! charge they are going to slap on my account. Am i right or not??? Grrrrrrrrr
if you cannot make a dd payment ask the branch to recall it before 3.30pm and you wont be charged. You do need a valid reason so dont abuse it:rolleyes: hope this helps!

When we've argued they've usually credited it (Abbey) tell them you'll take it to the ombudsman - this is about transparency and keeping customers informed of the rules, not about the charging (or level) of prices.
Good luck"You must be really proud of your kids?"
Yes - but it costs me a lot for them to make me proud!0 -
Im currently with Yorkshire Bank and feeling a bit confused as to what is happening to my claim.. i received a letter bk from the bank saying taht the charges are because its my fault funds not in account so then went to financial ombudsman got letter stating would look in to then a following letter about the test case.. thing I dont understand is what does the test case mean??? iv read forums and other threads but still dont understand it.
Also my friend at work has contacted her bank and they have told her that the courts have decided that the charges are unlawful and if write in then will get charges back and that they are stating claims are being dealt with under test case to get people to STOP putting in claims.
AM CONFUSED.... HELP0 -
I put a reclaim in just prior to the test case and due to the timing was told it was put on hold. However I've noticed people still reporting successes. Are these post test case? I'm intrigued. Thanks if anyone can answer this!0
