Hi i am sure i posted the message above in the success forum. Sorry but a few of us are asking the same question. I know there are successes being posted but are they pre or post the staying orders. It is just a simple request to the posters if they could put on date started claim and date paid out. Pretty please. Looking through this thread as i say some folk are getting frustrated. I hope there is someone out there who could advise me quickly as I'm sure I've left things really late.
Basics are I'm claiming from HSBC for approx £1200 in bank charges. I have a court hearing on Monday 26th Nov at Preston City Court. I have recieved a letter form DG Solicitors stating that they are applying for a stay to my hearing.
Unfortunately everything in my life went upside down in the last month with my works going into liquidation and as yet being unable to find a new job. Added to that I've my second child due in 8 weeks and have 3 credit cards and a mortgage that need paying and I've no savings!!
Needless to say that I took my eye off the ball and I have just looked back on my first letter regarding the Allocation and it states that I need to deliver copies of all documents that are going to be used in the hearing 14 days prior. If I'm still required to do so then I have Monday to get all this together by and I haven't started. Getting it to the courts is easy but the solicitors is in Birmingham!!
My questions in essence are this:
Am I right in thinking that the Judge decides on the day of the hearing that it is stayed?
What do I do if the bank don't send me any of their documents?
What happens if my copy arrives late to the Solicitors?
Do I actually still need to send these docs if its likely to be stayed?
Am I eligible to claim hardship to sway the stay and should I have done something to flag this up with the bank already?
I've tried to look on the CAG site but theres so many pages I find it difficult to follow.
Any advise or links would be greatly appreciated.:eek:

You should put in your court bundle as it has been asked for and not assume that the bank may apply for a stay. Link to the relevant thread is here...

Yes you do.

Basically yes as to "claim hardship" is really to make sure the bank will look at your claim to start with whereas your claim has reached the court stage although its no bad thing to draw up a statement about your finances to have ready.

i too trying to sort out sons money matters.how long did it take? did you need to open another bank and move overdraft and direct debits? how many of the letters did you need to send? need help i have never used my overdraft stupid about money matters but he cant do it on his own.0

Hello, After reading everyones post, i decided to post a letter to capital one and nationwide asking them to send me all bank charges for the past 6 years plus intrest. i kindly asked them for a refund and to write back. That was a week ago today i sent the letter recorded. Does anyone know how long to wait for a reply??
Also, i know they wont accept me asking for a refund, so iam then going to write back to them saying i will take it to court. and then await there reply..also how will i go about nationwide as i have a overdraft with them..and i know if they pay back whats mine they will close my account..so do i make another bank account with another bank and get my money each week put in to that bank account and pay off say £40 pound a week to nationwide for my overdraft? I also have e-savings with themSealed Pot dec 08 - dec 09 so far £27.67, Live off £4k Spent £330.20 GC £1,200 for 2009 Spent £50.78 PaD so far £650.07Debts: L/woods £154.00 C/One PAID O/D £649.90 Next £299.95 O/D PAID Gas £72.60 Electric £155.73 Mum £640.00 Orange £490.320 -
Right then where do I start haha.
I stumbled upon this website and realised that I too have a few hundred quid of fees for going slightly overdrawn. I accidently went overdrawn last week by about a tenner and sure enough they slapped yet another £35 fee on my account which is going to cripple me when I next get paid.
I say it will cripple me because I am only bringing in £93 a fortnight through Job Seekers allowance as I am awaiting my date to join the RAF and I need some form of income. So next time I get any money they are going to take a large chunk of it away from me and it's going to make my life incredibly difficult
Is there any way I can email barclays bank about getting this money returned to me and if so can anyone tell me what I should say. Sounds abit stupid I know but I do not know where to start here and I could really use the £200+ they have taken from me over the past couple of years!

I wish that the HSBC were like that, but alas they only employ the "Jobsworths" of this world.We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers0

Hi All,
I know this seems like basic questions but I was wondering if you guys could help me.
I have recieved my charges from HSBC £2307 in total, they fall under 2 categories Overdraft Fees & Recall s/o-d/d.
Can I claim both of these charges?
They enclosed a letter basically tellin me that until the OFT case has finished my claim would be logged but not actioned. Is it worth me doing it anyway?
