All started in Nov 2012 - remembrance day empty car-park at Manchester Royal Infirmary Wife long term sick - No blue badge on display (there wasn't - it was forgotten about - we like Remembrance Day) Rumours abound from staff there who've ignored the CPP letters too, so I'm ignoring them as far as I can before they re-possess our house :rotfl: Ill scan and post these letters ASAP or just make copies available if they're of any use. I'm on the "Final Reminder DO NOT IGNORE THIS NOTICE" type....hey ho.

    I wouldn't be hiding and ignoring, I would be writing to the Infirmary and asking why they allow their agents to break the Equality Act 2010.

    Harassment like you are suffering becomes a breach of the Act as soon as the parties 'knew or should have known' about the person's disability.

    So write and tell the Infirmary in a complaint letter (enclosing a copy of EVERY THREATOGRAM you've had so far!):

    'We got a fake PCN from your scam parking agents and ignored it of course because we aren't stupid and are aware it's not a real enforceable parking ticket and has about as much legal clout as a Burger King Flyer on a car windscreen.

    However, the level of intimidation in the letters is really getting stupid now, this is indefensible harassment by you and your agent. Have a look at what your patients are being subjected to by your agents, are you proud of this debt collector threatogram drivel bombarding innocent people?

    And in our case, to continue with this harassment is illegal - because it's a breach of the Equality Act 2010. Take formal notice that this is disability discrimination if you allow it to continue now - and I want to know what you are going to do about it before you compound this error of judgement?

    Here is a copy of the Blue Badge so you know we are disabled and allowed to use disabled bays in car parks (even though Blue Badges are not the only indicator of disability of course and the scheme is for Councils ONLY (on-street-only) despite the lies on the signs about having to display this Badge.

    As the disabled person as the driver/passenger in the car when the ridiculous fake ticket was placed, we knew we were allowed to park in that bay unharassed - and do not in fact have to prove our 'disability need' to anyone. You have a duty to make reasonable adjustments for disabled people and that does not mean harassing them over whether an irrelevant permit could be seen or not. As this car park is connected to the Hospital, I would have expected a much more thorough knowledge and understanding of breaches of the Equality Act 2010 than this example - no doubt your parking agent doesn't have the legal knowledge but, sadly for them and you, ignorance of the law is no excuse for disability discrimination.

    If you do not call off your parking agent now you 'know' about the disability, your own 'direct discrimination' breach of the Equality Act 2010 will be proved.

    If you allow your parking agent to continue to send me threatogram rubbish like these (enclosed) you should be aware that you are jointly and severally liable for damages for distress, harassment and disability discrimination. There is also a question of a Data Protection Act breach, because now you are aware of the disability, for you or your agents (and/or their agents) to continue to store/use/share my data in connection with this 'incident' is without cause and unlawful.

    Hi

    My partner has just received a letter from CPP, Northampton for an alleged violation in January 2013 in the car park at Sheffield Children's Hospital. We remember the date as our son was having a major operation at the hospital that day. The claim is for £80. There was no ticket on the windscreen when we left Sheffield.

    I have called CPP and all you get is a line that confirms the car reg and invites you to pay by card - so I don't even yet know what the alleged violation is.

    Also, the car is a motability vehicle owned by them - registered keeper is my partner Mrs H Jones - yet the letter is addressed to 'Mr H Jones'. There is no Mr H Jones at this address (and my surname is not Jones).

    The letter states that they will be taking the matter to County Court.

    Any advice please?

    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
