    Love to see that stand up in court! A multi million pound business that guesses RPI figures - which if guessed incorrectly could cost them hundreds of thousands of pounds in lost business by customers cancelling!

    What should I say in reply to this email ?
    Considering that I never mentioned that I wanted to cancel - they appear to be on the back foot now - sending meaningless (general) emails to people !!
    I was surprised to hear this admission - which may prove useful for the case against EE ?

    So a customer you receive a letter from T-Mobile saying the monthly plan costs have gone up. They announce to the press in March the price is going up by RPI 3.3%. Customers are up in arms and start to place legitimate cancellation of contracts on the only information they have access too, a published RPI and Customer service telling them this is based on the figures release in February. T-Mobile now have a problem. The letter sent out contains a higher RPI than the one publish RPI in the previous month.What happen now T-Mobile start stating they have speculated on what the RPI was going to be when they send the letter out, one that they and the customers could not check!!

    TMobile still have a problem using that strategy. The 'ANY' Terms of service for pay monthly customers joining before 30 October 2012 as the T&C's comes into play because the RPI release in April is still higher that the RPI released in March. The T&C's say - 'increase in Your Price Plan Charge (as a percentage) higher than any increase in the Retail Price Index (also calculated as a percentage) for the 12 months before the month in which We send You Written Notice.

    Interesting, but the time frame in which one may cancel is limited and even described as"immediate" by TM. I for example asked to cancel after the letter and before the publication of the March figure. (I asked to cancel on the 7th). Are TM expecting us to cancel or not cancel in a speculative gamble the way they are willing to gamble on the RPI? I suggest not and as one may only make a decision based on facts and the fact is the March figure was not available then cancellation would absolutely be appropriate in the interim period. (4th April to the 16th).

    Courts also take a dim view of companies deliberately vaguely dating correspondence for sinister reasons.. 'April 2013' is not a date!

    The terms clearly state that TM may rise the prices by RPI to the month prior to the letter. It does not state "T Mobile's best guess as to the RPI".... EVEN if that was a good guess (possibly even informed by insider knowledge!!).

    I have just got my PAC code and have to pay £190 cancellation fee. I shall shortly sue T Mobile for that money and this will all get an airing in open court.... for the grand sum of £25... Don't you love county courts??

    If you are interested I shall let you know how it goes ... They will settle at last minute on a 'no admission' basis.... or so they think :rotfl::rotfl::rotfl:

    That's a good point, the immediacy of termination would meant there is no contract in existence at the time of the eventual release of the following months RPI.

    A point I will be making to CISAS if T-Mobile try and use it as a defence. In my case my contract was terminated on the 7th, 9 days before.

    Thinking more about this email response. The RPI was published on April 16, and the requests for immediate termination was before this date. Therefore the request to terminate without penalty immediately must be accepted and T-Mobile could not wait until April 16 to accept the request.

    That's the problem - I did not request termination - I just want NO PRICE INCREASE! !
