just submitted my complaint to CISAS as i still havent herd from T mobile, mind you they are probably busy0

Following three emails sent to the Exec office:
1) If I don't receive a reply by the end of the day TMobile accept that I am within my rights to request termination without cancellation charge and will provide PAC and unlock codes - no response
2) As I didn't no receive an response TMobile has accepted my request to termination without cancellation charge and will now provide PAC and unlock codes - no response
3) If don't get response by the end of the day today we are formally in dispute and the complaint will be lodged with CICAS - no response

I have been following this forum for several weeks now pretty much waiting for news that T-Mobile are finally giving in and will give us all a fee free cancellation. However the more I wait the closer I get to the 9th May deadline for cancellation.
It is time to take action but I have no idea where to start. I would appreciate some advice on what my first plan of action should be. I have seen some of the emails you are all sending but they are too confusing and I can't really follow the timelines and details.
If I should start will an email, who should I send it to and what should it include (rough outline)

A step-by-step guide as to what to do next would be very useful to me too.
I have read all the posts and understand the argument(s) for pre-Oct 2012 contract holders. If anyone can help i would very much appreciate it.

All you have to do is phone CS and then follow up with emails, state you wish to cancel as is your right in terms of section 7.2.3.3.
The email addresses are already listed.
Make sure you keep any confirmation emails or replies to prove you have given the cancellation notice within the 30 days as per the contract.====0 -
Start by phoning 150 and state that you wish to cancel your contract because Tmobile have breached condition 7.2.3.3 and say that in the letter you received the 3.3% is higherthan any increase in the rpi, say it as it says in the contract, you can't be wrong then, if they ask which month the 3.3% is higher than just quote back what says in 7.2.3.3.0

They will refuse you no matter what you say, expect that. It's a matter of telling them you wish to cancel because the rate in force when they notified you was 3.2% while they increased by 3.3%.
It doesn't matter what the rate later became, but that's all for your CISAS appeal (or hopefully T-Mobile will see sense when the first cases are hopefully decided against them and they then allow those who have cancelled to leave).====0 -

Here is a script for you for when you call 150:
PRE and POST October 2012 (POST October = contract stared 1st November 2012 onwards)
Phone 150
Remember they will try to confuse you and tell you all sorts of other things so make them stick to answering the questions, and DON’T let yourself be drawn off the script below:
YOU - “I wish to cancel my contract WITHOUT PENALTY TO MYSELF as T-mobile have BREACHED MY CONTRACT”
THEM - “Is it because of the price rise”
YOU - “NO it is because the price rise is in breach of the contract terms and conditions”
They will then give you a long talk as to why they are not in breach - just listen and then say.
YOU – Can you tell me what months RPI the increase was based on”
They may answer with a month if so:
YOU – “thank you I will write to head office for clarification- can I have your name and number so I can ask for a transcript of this conversation”
Note the name and number, thank them and hang up.
If they go into another long speech just say;
YOU “I just need an answer to a simple question – what months RPI was used” (You have to repeat this several times before they give you a month – it took me 3 attempts!!!)
Also see my post number 158 - there is no one on 150 or in cancellatons who can cancel your contract without a penalty - this justT-Mobiles first line of defence to put you off.
Once you've gone through that bit of fun you need to email the excutive office and Olaf Swantee -you should be able to pick up what to write from earlier posts, if you need mote help just ask.0 -
