I think this is another ambiguous point. In their defence T-Mobile remarked that a customer would still have "sufficient time" to see if they could cancel, by waiting until 16 April. Of course sufficient time doesn't equate to the 30 days you should have to decide
Although it might support the argument re ambiguity when considered alongside all the other evidence, I don't believe it would be enough in isolation to get anywhere at CISAS - TM will argue that they gave 30 days' notice of a 3.3% increase and, strictly speaking, wouldn't be wrong in saying it. Then again, it all seems to be down to each individual adjudicator's legal reasoning, so who knows?!0 -
I seem to remember that if an SMS is not delivered within a specific time then it's removed from the system. However as this timeout is controlled by the provider then I would imagine T-Mobile could override it. Their system should show if a text had been sent, and possibly if it had been received.
Delivery of text messages can't be guaranteed. T-Mobile would only have control over it if you are in the UK. If you were roaming abroad then I doubt they'd know if it was delivered or no.
If you're not using the SIM then that would show in their records.
Yes, there is message validity period, I think by default it is 1 week, so if after 1 week I didn't turn on my phone then the message is deleted from the mobile operator SMS queue. I forgot to mention that I bought my T-mobile contract over the internet via mobiles.co.uk and as far as I remember I didn't get any T&C's in my starter pack. So as a start point I should use that they (T-mobile) didn't sent me a notice about the price increase and I have a right to cancel the contract without termination fee? Thanks again0 -
Yeah, I phoned CISAS and told them I accept the decision over the phone last thursday. Got the e-mail confirmation but surprised to have nothing from t-mobile yet considering how fast someone else on here got a response. Sims still being used but I'm gonna call t-mobile now as I want this finished with ASAP.
Does anyone have the executive office number as normal customer services are completely unaware of this. It was posted here a while back but there's so many posts its impossible to find. A landline if possible.0 -
Anymore wins/losses with CISAS?
I'm awaiting my adjudication now. Had an email last Thursday after I failed to add comments to tmobiles defence (I was away on holiday!!) I hope it doesn't affect my chances of a successful outcome too much...
How long has the adjudication process taken for others?

Yeah, I phoned CISAS and told them I accept the decision over the phone last thursday. Got the e-mail confirmation but surprised to have nothing from t-mobile yet considering how fast someone else on here got a response. Sims still being used but I'm gonna call t-mobile now as I want this finished with ASAP.

I sent my comments on T-Mobile's defence on 17th June and CISAS acknowledged it the following day, so i'm playing the waiting game now....A big believer in karma, you get what you give :A

Once an adjudicator is appointed they normally make a decision in 3-4 days. I hope the lack of response from t-mobile is being caused by quite a few non registered users who have been following this winning their cases.0

Explained re CISAS decision and all fine, they said the charges would be cancelled when account is closed.
I told them I didn't want to be charged but I suppose it doesn't matter if I have the CISAS decision in my favour. Will ring again, cheers.0 -

Well that makes me feel a little better. I had a read back through the evidence I submitted originally and was happy that I covered a fair amount of the main points in my emails. Fingers crossed!0
