    I do wish you all luck, but I’m a little worried that you’ve got an optimistic view of how CISAS deal with complaints like this.

    In my claim against Orange, CISAS decided that repeatedly reading Ts&Cs that didn’t apply to me, selectively removing the correct Ts&Cs from their website, breaking off communication without answering direct questions, producing demonstrably false statements in their CISAS defence and then relying on an argument that essentially confirms that Orange have been systematically misleading their customers as to their rights, was no indication of Orange acting unreasonably or outside a duty of care.

    My advice would be not to make any assumptions about how EE will attempt to defend themselves – and include all the evidence that you can when you make your initial CISAS complaint.

    I’m now taking EE to the SCC and just hope that you won’t have to too.

    Well I have just received a response from CICAS rejecting my complaint on the grounds of not having a deadlock letter despite the fact I included the email received from T-Mobile stating "As you have now reached the end of our escalation procedure, we would suggest that you seek independent advice, if the above is not to your satisfaction." which has been deemed satisfactory for others.

    Shambles of an organisation if ever there was one.

    I have been referring to your situation in earlier posts on this thread so everyone is aware of (although I think they are already) of what a tricky beast EE are. As I have an Orange contract -like yours - I will try and cover all possible angles in my application i.e.
    1. either they have changed my T&Cs without telling me, so I can cancel, or
    2. they have not changed my T&Cs so they can't increase the price, so I can cancel. And
    3. Given RPI is higher than wage inflation it is material detriment, and
    4. As per my current/old contract I only need to prove detriment, and finally
    5. The price clause is invalid as it was not drawn to my attention at point of sale - I have documentary evidence of deliberately being mislead on that point by Orange (look at your welcome letter if you still have it).

    Once you get to 8 weeks from making your first contact with TM you can go to CISAS anyway without a deadlock letter.

    I will be writing to Graham at Ofcom later with a link to the story and copy in Margret Hodge and Ed Vaizeye (plus some journalists - plenty have covered the OFT story). Asking Graham if he thinks in light of this Ofcom should get a little more proactive in this dispute! And how it might reflect on Ofcom should TM customers actually be right!

    Maybe worth others doing the same - the more that write the more notice it will get.

    Get a grip and realise that, whilst immoral, the providers are not doing anything illegal.

    Until you manage to change the law this will continue to happen. FACT.

    Perhaps a mod can make these fact into a sticky?

    if we all took your stance on things and sit back and do Nothing and let companys walk all over us without putting up a fight of some sort then we wouldnt get nowhere.

    i for one am quite happy to take it further, weather we win or not then at least i can say i tried.rather than sit back n do nothing like u suggest.

    i have got out of contracts due to price rises before without charge, yes rpi is slightly diffrent but hey its worth a try, at the end of the day a contract works Both ways

    Put simply this should be a sticky with suggestions and contact details. Not a mindless drum banging session.
