  • We think we know what we what to say when we speak to the EA. however we are unsure about when to approach the EA to talk about it?

    I totally agree with what you are saying, but we are also getting told not to approach the vendor and try and get a date for exchange/competition.

    I am more than happy to look for alternatives but we need to know that we are actually going to move into the house, otherwise it is going to be throwing more money down the drain. We will already be losing money if she pulls out, we don't want to increase that amount by moving things into storage and staying in a cheap hotel.

    I agree that our vendor is in an awful awful situation that I wouldn't wish on anybody, but I also dont think it is completely unreasonable for us to expect her to think about us.

    I haven't argued against the idea of you gently contacting the vendor via the estate agent, not sure why you are defending yourself in response to my post. My concern was your comment about being homeless which read to me you were considering sitting tight where you are, when there is another tenant to consider.

    Even if she agrees to push on in the next few days you have no guarantee she won't change her mind or collapse with clinical depression and be uncontactable, you only have certainty at exchange. Which is why I am suggesting you start considering alternative arrangements. Yes you may lose out financially that is the nature of the beast, that is why people advocate not handing in notice until exchange, the losses are ringfenced.

    I don't think its to soon IF you put across that your willing to wait for a reply - i.e put the ball in thier court when they contact the seller.

    Simply tell the EA what you want to know, and ask them to find out when they have contact the seller can you please ask....

    Then you don't have to worry whether your doing it to early as its up to the EA :-)
    People don't know what they want until you show them.

    Feels like we are being told to put what everybody else wants/needs 1st and just sit back and absorb the financial costs!

    You are being told that, the wonders of getting a variety of amateur opinions on a forum! :p Appreciate it is frustrating but there is a lot of wasting money associated with purchases that drag on or fall through; you should have a contingency for this sort of eventuality, obviously I hope you won't have to use it.

    TBH of all the parties involved you are arguably the ones who failed to plan for the sale not going through by jumping the gun with serving notice. Sorry to bang on about it, but I really hope others learn because we say or over and over again but people just see the modest sum of rent not the bigger picture.

    However we are then running to risk of messing the vendor around as may have to push back the competition date.

    Surely it would be better to allow her the chance to tell us what is going to be best for her!

  • Any thanks for all of the advice for everybody so far, we are going to speak to our solicitor, EA and landlord tomorrow, probably in that order and get advice about what they think is the best way forward.

    Will post back here when we have any more information about what is happening

    And you don't really want to be messing the vendor around at such a sensitive time - adding the stress of a house sale going belly up to the loss of her father. Ignore the insensitive people here :p:p:p who would not contact her at this time and allow her to say what she would like.

    Roughly. I am mainly having a go at the delicate flowers.

    I would discuss with LL first to discover what his expectations are. Then with my solicitor to double check how the sale was going and exactly what was left to do - and who is responsible. Then have a little pause to think. Finally set out the options for the EA, prepared to have a little re think..
