    Just wondered what the phone was, not that I dont believe you but im interested in the damage if you dont mind posting the pics.

  • Even if you had a point about the poor quality of the phone, you would still need to argue with the retailer that this is caused by a fault and NOT because you dropped it. As you have dropped it, it is going to be very difficult (probably impossible) to prove. As such, I think you'd be better taking the hit and paying for repair.

    I strongly believe you won't get anywhere with the retailer so it is up to you as to how much time and effort you want to waste trying to get something from this.

    I have an iPhone 4s and luckily (touch wood) mine seems to bounce! I have however spent time working in Orange's insurance department and know of many others who have not been so fortunate. In similar situations, carpet, not great height, completely mashed screen.

    Have a look on ebay for the replacement parts and on youtube for DIY repair tutorial.

    Also, don't assume that I use words such as init. I'm actually quite smart. If you require any empirical evidence to verify that claim one shall have to wait forever as I will not make any provision of such evidence to satisfy your request. Further to this I reject your assumption that I have an entitled attitude, or think that the world some how owes me something and that others are responsible for my actions.     Was the contract entered into by yourself or by your parents?

    As others have said, you're going to struggle with this one to say the least. Faults caused by the user are not covered under SoGA.

    You cant really compare your pen to your phone because your phone is more complex and expensive (so should be taken care of better than you would a pen). There is more that can go wrong with a phone than a pen.

    Hell you've probably got more of a claim against whoever you bought the silicone cover from if they advertised it as something that would keep your phone safe from knocks/bumps/dropping. But a lot of companies only advertise these covers to protect it (along with a screen protector) from scratches/marks/dirt.
