Actually, they're not. This is a mobile phone. That I brought from Tesco Phone store (14 days with them) then it switches over to the network-- who get the repairs done by the manufacturer.
That's awesome, so Tesco have changed the law? Wow!

Oh but the contract is to provide you with minutes, text, data etc. Has the SIM Card also stopped working and providing you with these features if you put in to a different phone?

Your statutory rights and a warranty are completely different things. Warrantys are usually provided by a third party, usually the manufacturer, as is the case here. The warranty is in addition to your statutory rights under the Sales of Goods Act. Your statutory rights are with whoever you bought it from... And the retailer can NOT contract out of this or transfer liability, covered by the unfair terms act rendering it void. They can however opt to use a third party (usually the manufacturer) to undertake such work, but still leaves them responsible for organising such.
Here you are claiming the goods are not of satisfactory condition. The manufacturer has stats this is outside of the terms if the warranty - so if you feel you have a case under SOGA then this is against the retailer, in this case being Tesco.
But the goods don't appear to be inherently faulty, but have been damaged by you. I don't think it unreasonable for the retailer to reject your request for a free repair and the manufacturer has no obligations to you to do so.0 -

Unfair and unenforceable clauses in contracts do not trump your statutory rights. Bound to be something on the OFT website. Don't see the point in the thread if you know the legislation better than all the regulars here. You asked if the letter is OK, the general consensus seems to be no, because it's addressed to the wrong entity for you to claim under SOGA.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0
