Poor Build Quality repair?

Today on the 5th April 2013 the phone dropped from my pocket on to the floor, while I sat on a chair. This distance was about 1ft or 0.33m.

Tbh, as I'm a poor student with a £370 phone that is currently decorating my draw, I don't think they should mend it for nothing. But here we have a case of a build quality issue in my view. Although I know that I dropped it- from your pocket to the floor shouldn't break it, in my house where there are carpets. It landed directly facing upwards, there isn't even a mark on the thing from being dropped.
Plus this is the SECOND phone that I've had, I had to return the one that was initially supplied on the 17th of Feb, 7 days after I took out my contract due to internal damage on the screen.
So I've got BIC pens on my desk right now that I purchased 10p each from the poundshop that are more durable than my £370 smartphone....

Unfair and unenforceable clauses in contracts do not trump your statutory rights. Bound to be something on the OFT website. Don't see the point in the thread if you know the legislation better than all the regulars here. You asked if the letter is OK, the general consensus seems to be no, because it's addressed to the wrong entity for you to claim under SOGA.

Complain (to the manufacturer) all you like but if you want a remedy then you need to enforce your statutory rights against the retailer. I'm wondering why you're finding that so difficult to understand.Oh okay, I see the issue here.

Also, don't complain about being a "poor student" on the one hand and then mention a £370 phone in the same sentence. I don't think you'll get much sympathy on a MSE site.
