So the law is on my side and should I wish to take county court action, with sworn statements or witnesses, I will win.
What a waste of time.
Since you already apparently know the law I agree, you should go straight to a small claims court and make sure you tell the judge just how right you are. I'm sure s/he will be very impressed.
In reality, you need a proof of purchase, you don't have one, Aldi are right. I can't believe this is a genuine thread with the greatest respect.0 -
FOR £3.99 !!!!
ALDI have no financial benefit in not replacing faulty goods, only the [STRIKE]negative[/STRIKE] positive impact of alienating problematic customers who are trying to enforce the law without actually complying with the law themselvescustomers.A witness is not proof of purchase so good luck with that
It can be. Small claims goes on the balance of probability, just some "proof" carries more weight than others. This is probably the most dubious form of proof of purchase that you could get though, its not even an independent witness :X
OP, idid you ask the staff nicely if they would look it up on their retailers copy - they've done this for myself and family/friends previously. Give them the time approx, date, price approx along with other items you bought and they've never had a problem locating the receipt for us.
And please, stop banging on about how aldi are in breach of SoGA, they arent until you can show them valid proof of purchaseYou keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
@ unholy angel - noted; my comment refers to the fact that the witness will be somewhat biased (or misguided:p)
DS once bought a top (expensive hoodie) from a sport retailer; the sleeves (not the whole thing) faded when washed - and it was the same design all over. But he had paid cash; thrown the receipt and they (quite rightly, but annoyingly) refused to replace. And it was a LOT more than £3.99.Don't put it DOWN; put it AWAY"I would like more sisters, that the taking out of one, might not leave such stillness" Emily DickinsonJanice 1964-2016

Oh if i was a retailer I wouldnt accept a friends say so. A court might but then a judge is usually experienced at spotting liars. Not always, but most of the time. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Must thank all contributors to this thread, I am truely gratefull for the honest opinions given both for and against.
I have been back to Aldi, bought another box and kept the receipt, taken the broken box back and got a refund.
I am honest beyond the expectations of most people and genuinely think that having to be devious should not be a requirement in this age of regulation.0 -
While reading through the various replies on this thread, I wonder if anybody knows anything about the mis-selling of PPI. I paid £8,000 in PPI premiums but have no paperwork to prove it, do I stand a chance of getting my money back ?0

Thats something you will have to look into, you might be able to get a copy of the agreement from the lender.0 -

I would start off with getting in touch with the lender concerned and asking them to provide you with a copy of the agreement - or you could ask them outright whether you had PPI. With it being such a big review - they may just see from the file that you had it and go straight to reviewing it.
£8,000 is a very high premium though - are you sure the figure is right?0 -

But I thought you wanted to buy a better one?
ETA, I am quite disappointed in this too, I was looking forward to tales of the court battle!0 -
