CISAS have today (yesterday 9th) submitted my claim to Orange. So their defence should be available by 23rd July.0

Make sure you keep up updated.
Weve phoned Orange and asked what T&C's apply to my partners account. They couldnt tell us over the phone, but stated they would send out a copy which should be received within 10 days. They also confirmed this with a text message. Well today was the 10th day and nothing has been received, so need to chase this up.
We also sent a message to the Orange Facebook team asking which terms and conditions apply to the account, giving them the date the account started and also account number and asked them to quote a couple of the terms. Needless so say, they quoted the wrong terms and conditions!
Hopefully Orange will send out the wrong t&c's in the post, and fingers crossed that should hopefully be enough to win when we take it to CISAS!0 -

I am now going 'formal' with Orange. CISAS papers done, gave them a final chance to resolve via email to the CEO Team and the man himself. We shall see.
Edit: Just had a reply, looks like I may have a problem! I've not paid the account for a month or so (possibly two) and seems they've closed it. Am I knackered, or can I bring it up to date and pursue as per?

I would suggest you make them tell you on what grounds and how it's terminated, if its for non-payment or with an early termination charge you would still pursue through CISAS with the sim of a early termination with penalty.
If they will confirm they have allowed early termination without penalty then you have terminated without any problem to you and your credit file.====0 -

EE are a tricky bunch of vipers and I would not place ANY reliance on which T&Cs they say you are on. Remember they caught DamePeggy out this way - they have tried to catch me out on my TM contract and they have mislead TSandCS on their TM t&Cs by confusing which T&Cs people re on.
Either follow the course I've PM'ed you on my claim, or if you can wait I can let you know what they put in their defence to my claim before you submit yours. Their defence is due 23rd July to CISAS, so I should receive it shortly afterwards.
Also if you have evidence of when you asked for the T&Cs to be sent you can use that against EE to claim compensation for not responding in an adequate timeframe.0 -

Were using a mix and match of both your advice and the advice of DamePeggy.
So far weve got:
- Email quoting T-Mobile terms and conditions (:rotfl:)
- Website pointing to new terms and conditions despite clicking ont he link that should point to the correct ones
- Facebook message from Orange stating the terms and conditions that relate to the account of the new ones
- *Hopefully*, a copy of the new terms and conditions when they post them out.
I think that will be enough to take to CISAS and claim Orange have changed the terms and conditions etc etc etc. I'll also add that if Orange claim they have not changed the terms and conditions, then the RPI rise is unenforceable etc etc0 -
I’ve been away for a bit and, for some reason, I haven’t been sent any emails telling me that there have been posts on this thread. Here’s an update of what’s been happening with Orange.
I’ve postponed taking Orange to the small claims court as CISAS have accepted my request for them to adjudicate on the basis of the non-existent document. I kept my complaint as simple as possible - simply stating that the terms were clear in referring to a specific document and that if they were unable to provide me (or anyone) with a copy of it, then the clause should be ignored. I pointed out that it is up to Orange to ensure that their contracts are clear and up-to-date.
I understand (from https://www.tomforth.co.uk/orange) that last year CISAS were refusing customers the right to take this specific matter to them on the basis that it was of a legal technicality. However, in the light of the T-Mobile cases being approved by CISAS on a matter of arguably more complicated legal complexity, I’ve given it another try with CISAS. They did not reject my case immediately and Orange/EE now have until today (19th July) to respond to my case. They may well argue again that it’s a complex legal matter, but they’ve done that unsuccessfully for some with the Tmobile case, so I’m hoping that CISAS have changed their policy.0 -
Good luck to everyone using either or both of these approaches. For further evidence (if it were needed) of how laughably pathetic EE are in their handling of this I thought I'd share this with you.
Since CISAS rejected my original claim (as I'd not proven the change in Ts&Cs) I emailed Orange/EE to ask where my V14A Ts&Cs were on their site and, if they weren't there, why were they being treated differently to dozens of other sets.
They told me that they were in the legacy list.
I told them that I couldn't find them there and asked (nicely) for the direct link.
They told me that as my CISAS claim was rejected they would no longer be replying to any more correspondence.0 -
