Read the OP, the retailer has passed it to samsung to investigate, and they have confirmed that it is within Tolerance (bit like the old issue of dead pixels on screens)..
Is it 'true' banding? as in a visible line, or is it the image 'shifting' along which happens with larger screens \ panning and poor connections \ settings \ interference..If it is ruining your viewing, and wasn't present in the showroom, then that is not "fit for purpose" in my book. Personally I wouldn't put up with banding and as the purchase was so recent you have quite a lot of rights.
Firstly, under the SOGA it is the responsibility of the seller to repair or replace a faulty item in the first 6 months. It is also their responsibility to prove it wasn't an inherent fault. There is no reason why you should be dealing with the manufacturer at this stage. Don't let Currys fob you off, whatever they say.

If you are really stuck, tell Curry's you will be calling in an independent engineer but if he agrees with you, you will expect them to foot his bill on top of dealing with your replacement.
Remember, early on you have more rights, so strike while the iron's hot.

With my old Sky HD Box, some Sky channels looked crap..
But crisp with Xbox \ PS3 sources.
Had a replacement box and all went better, but sometimes live hd football - especially ITV HD looks crap on it..
Its just part & parcel of a larger screen tv, which really ought to have a higher resolution that what we now take as HD.

There are five lines spread evenly across the screen the lines are 2 inches wide and run vertically from top to bottom. Can be seen onany background when the camera pans not just on certain colours0 -
I have checked the image with xbox 360, blu ray player and sky hd all with quality cables0

I have found a template letter on these forums, I think I'll hit Currys with that and see what happens?
I am going to try for a refund as the TV is not fit for purpose and they wont fix the issue.0 -
This may be difficult. Being fit for purpose means just that - and you can do what the retailer expects, view programmes.
Your issue of banding is something they say is within tolerances - the same holds true for dead pixels, there has to be 4% or greater dud before it is a recognised fault, so if they refuse to accede to your request you can risk a SC but there is no guarantee of a win.
I had a similar issues with a plasma screen (blacks were grey, and dark scenes looked muddy). But the manufacturer said this was to be expected - their engineer even called to recalibrate the screen and spent an hour doing so. I never saw any difference, and in the end I sold it and moved on.
The larger the screen, the greater the tolerances and we are supposed to accept this.0 -
SOGA states that goods must be of satisfactory quality. The objective test is what a reasonable person would consider satisfactory. Courts tend to side with the 'man in the street's' rather than the retailer's or manufacturer's view of satisfactory.
Higher quality, more expensive goods from top manufacturers will generally be held to a higher standard than cheap, second-hand items.

Do you have a way of getting it into store?
Take yours in, ask them to set them up alongside each other, plug same source in and show problem. Afterall your purchase was based on what you saw in their store.
Much more likely to get you moving than template letters on something so debatable...0 -

Good news I called samsung again and spoke to a supervisor who said they would send another engineer out for a second opinion. The engineer came this morning and as soon as he saw the TV he said it wasn't right and ordered me a new panel straight away which will be fixed next week
I'm so happy, thank you all for your suggestions0
