Glad you have set them a deadline and as much as it will hurt, please don't back down if 2nd Sept gets here and you are still in limbo. You have to stick by your decision and follow it through.
We had to make a decision to walk away over new year and we are so glad we did. Our vendor was on for £255K. Accepted an offer of £250K so we didn't have to pay the stamp. We instructed sol and thought everything was fine. 2 weeks later our sol still didn't know who her sol was so I chased the EA to get details. Apparently our vendor hadn't got a sol yet as she wasn't sure we were messing her about :eek: What the hell?!?! We were furious :mad:
Apparently it boiled down to she wanted full asking for it so expected us to buy somethings from her (big american fridge/freezer, tv on wall in kitchen, carpets, lights etc) Previously she had she would like to get a few quid for these, but now the sale depended on us buying them for £5K :mad: We told EA to tell her that if the sale depended on us paying £5K for stuff that was only worth £2K at a push we were pulling out. She got back to us after speaking to vendor and vendor said fine, pull out! So we did!!She so wasn't expecting that as she knew we loved the house since the moment we stepped foot in it. EA said she (the vendor) was gobsmacked that we had carried our threat through and actually pulled out!
So glad we did now as a couple of weeks later we found a much better house for a slightly lower price in a much better area!!

Todays update
Called the Ea again to see if they had managed to get hold of the Mrs (seller) they still hadnt been able to and so they said that they would have to do the viewing on Saturday. I called the Sol's to let them know and they said you cant do that you have to view before Thursday because you are getting the keys on Friday. I had got completley muddled with dates and stuff and when they said this Friday I first off felt really stupid for agreeing to a viewing the day after we are supposed to get the keys and then it suddenly hit me that this is going to be over soon.
I asked the sol if it was definate that we are going to get the keys on that date as I thought that there was still unresolved things like the paperwork that the Mrs still has not signed. The sol said that they had spoken to the sellers sol and they had said that they can assure us that Friday will be completion day. I then called the EA back and asked about a viewing before Thursday. After a bit of back and forth with me ringing my hubby and him ringing his dad to see if he can take me we eventually agreed that we would be viewing the house tomorrow (Tuesday) at 5pm.
I am taking a camera as advised by a poster on here (please forgive me for not remembering your user name) and I am going to photograph everything.
Its going to be a busy week as my mom is having a kitchen fitted (we are living with her until we move) and we are hopefully completing on the house. The worst bit of timing is that they said that the keys should be available not long after 2pm and my mom has got the vet coming in at 4pm to have her dog put to sleep (she is 17 had a good life and now her back legs have gone) I know she is going to be very upset and so will my brother and before they let us know the completion date I said that I would be here when it happens else my mom will be alone. As excited as I am about getting the keys I feel that I should be here for my mom so even if they are available at 2ish I ont be going to get them until after 5pm.
How typical is that though. Every possible thing has gone wrong with this. We have been through paperwork getting 'lost' in the post, a solicitor leaving, an estate agent leaving, the seller delaying so her daughter can find a place, the sellers disappearing for 6 weeks, a fire at the place they were due to go for mediation, 11 different phone numbers for the sellers none of which worked, broken promises, the sellers wanting to kill each other,the sellers disappearing again for 2 weeks and now when it finally looks like we are going to get the keys it will be delayed because of a dog:rolleyes:
I will let you all know what happens tomorrow with the viewing, no doubt the place will have had a flood or squatters will have moved in or something but either way I will update asap.

****Todays update****
We got to the house for 5pm and the EA met us there. It was the same EA that I spoke to on Saturday and was really nice to us but she seemed quite off with me today. I went in and was surprised to find that nothing had changed since the last time we were there weeks ago. And when I say nothing had chnaged I mean it. In the living room their clock was still on the mantle, the dining room was still filled with their sideboard, a glass cabinet with all ornaments in (it supposedly belongs to his aunt), the daughters bed was still in pieces in there and there were boxes everywhere. Upstairs was the same with boxes all over the daughters bedroom with photos etc in. The little table with the dog stautue on was still on the upstairs landing and the shed that they told us if we wanted to keep it they would sell it to us for £150 was still in the garden.
I asked the EA if all this would be gone and she said that they still hadnt been able to get in contact with either of them and that she didnt deal with this kind of thing but she would get the woman that does to phone them tomorrow and ask them. She then asked when we are supposed to be getting the keys and I said Friday. She seemed really shocked and asked if we had exchanged contracts and I said that they had called us in to the Sols and said that they wanted us to sign the contract and we had signed a load of paperwork and assumed that this included the contract. She looked at me like I was stupid for not 100% knowing. She said you havent had a 100% mortgage have you and I said yes and she said that we must have exchanged contracts as it takes about a week for that to go through.
The house itself was fine but it looks very neglected at the moment there are weeds in the overgrown front garden and the wallpaper and carpets look very tatty but we are replacing all that anyway.
I am very annoyed that a lot of their stuff is still there and so tomorrow I will call the sol's and ask them where we are. I am going to clarify the following points with them:
Have we exchanged contracts or not
What happens if their stuff is still there on Friday
Are we still on schedule to get the keys on Friday
If not when
After that I will try and get hold of the Mrs (who nobody can get in contact with AGAIN) and then try the Mr and ask him when they plan on moving the last bit of stuff and if they are aware that we are supposed to get the keys on Friday.
I knew that I would still feel wound up after visiting the house today. I am stressed because the EA thinks I'm a fool, some of their stuff is still there and becuase the house looks so run down at the minute.
I will let you all know what happens tomorrow.

If you have a 100% mortgage, you have to exchange and complete on the same day. If your solicitor thinks you are moving on Friday then they will have requested the funds from your mortgage company.
It's not a good scenario considering the circumstances. I get the impression you have somewhere else to live so I ould not pack up the removal van in Friday, just in case. Book it for later, if indeed that is what is happening.
As for the stuff, well, it looks like it's staying, doesn't it? Ask if it's staying, if you can get hold of it and inform your solicitor to see what they think, but I wouldn't rock the boat too hard at this point in case they delay completion again in order to remove it!
You will probably end up either taking the rubbish as the price to pay for getting into the house, or you ask your solicitor to make them reimburse you for the cost of removing it once you get in?Everything that is supposed to be in heaven is already here on earth.

Todays update
An early update today as I could not sleep last night and was straight onto the sol's at 9am. I told them that the house was fine but we were concerned as there were still quite a few of their belonging in the property. The sol said that the problem was if this delayed completion as they had already requested the money for the house then we would have to pay interest on it until completion. She asked me to give her a list of things that were still in the property and said that she would fax it to the sellers sol and let them know that it needed moving asap. She suggested that we try and get a hold of one of the sellers to ask them why the stuff was still there and when it would be moved.
As soon as I had finished with the sol I started trying to call the sellers on one number and my mom tried calling on the other. My mom managed to get through first and spoke to the Mr (seller). My mom has spoke to him before and he always seems to respond better to her. I think when I speak to him he can sense the bitter underlying hatred I harbour for him and his ex wife because of how much they have messed us about.
He told her that the stuff would definitly be moved by Friday. He said that he couldnt get a van until Thursday and that it would be gone Friday morning at the latest. He said that he would be there today as well to move the smaller items. This was a great relief and I called the sol straight back and told them. They said that they would still send out a fax to the sellers sol outlining what is there and that it must be moved by close of business Thursday or we will be with holding £200 for a skip to dispose of it. She said that this would hopefully give him the extra push to get the stuff moved. She also said that I would need to get down to the property on Friday to make sure that the stuff was gone before we could complete. That is a bit of a nightmare as I dont drive and the property is quite a distance away.
So I am keeping my fingers crossed and waiting to see what happens. Oh almost forgot to tell you, When the Mr found out that we had viewed the property yesterday he went mad. He said that the EA had told him that the viewing was not until today and that they shouldnt even have a key. What we didnt tell him was the reason they have got a key is because his wife gave us a key to the property weeks ago but we said that we didnt want it so on the advice of our solicitor we handed it in to the EA. The Mr said that he was going to call the EA and have a go at them. I called them to warn them but gosh only knows whats going to happen there.

Day before alleged completion update
Had call from EA to say that they had heard from the sellers sol and that they could not get in contact with the sellers again (this is exactly what you want to hear the day before you are supposed to complete).
She said that it would help if we tried to get hold of one of the sellers to explain to them that she has sent a letter to their sols saying that the stuff needs to be gone by the end of today or we are with holding £250 for a skip to dispose of it (I dont know where this lady hires her skips from but it sounds like an expensive place). I didnt exactly relish the prospect of calling them as it can be a very frustrating experience. The Mrs (sellers) number didnt work but that came as no surprise and the Mr went straight to answer service. I called my hubby up and he said that he would try (sorry that makes it sound like he agreed straight away, in actual fact he moaned about having to do it for about 15mins and ranted about how it isnt our job to have to get hold of them to pass messages on)
Hubby called me back not long afterwards to say that he had not been able to get through but he had left a message explaining what was happening on the answer service. I told the sol this and they said that it would have been better if we could have got through to them but obviously nobody can at this point. The sol said that I needed to make an app with the EA to view the house at 10am tomorrow to make sure that everything is gone and that I must call her straight away so that we can fininsh everything up. This is not as simple as it sounds as I dont drive and there was nobody available to take me so I have had to book a taxi to take me there, wait for me while I check then take me home again at a cost of £25 which isnt too bad but then again if I have to pick up teh keys tomorrow i will have to do the same again as the EA is 5 mins from the house but I will cross that bridge when I come to it.
I called the EA and made the app for 10am and told them that we had left message with the Mr about getting the stuff moved. She said that they would try him too but didnt hold much hope. Things are even more complicated tomorrow as as I have mentioned before my mom is having her dog put to sleep and she wants me to be there when it happens. The vet said that they would be there between about 2pm and 4.30pm which is about time I wuld imagine that I will have to pick up the keys (if we get them) so I may have to go on Saturday to get them instead which will be really frustrating.
We have also hit another snag as the van hire company has said that they will not hire a van to anyone under 25 and my husband has just turned 24 so he will have to get someone else to drive him. The only one that can really do it is his dad who leaves on a cruise for 2 and a half weks in a couple of days and we go on holiday a few days before they come back so we are hoping that if we get the keys on Friday then we can hire a van on Monday to move all our stuff, otherwise it will be another three weeks or more before we can move.
Anyway I will update tomorrow (probably several times if I have chance) and let you know what happens.
