Sometimes I think the same thing.
My plan for this week is to really go for it. I am going to call the sol's and the EA at least twice a day to check on progress. I am going to try and get hold of the seller and get her to call the EA if she hasnt already.
The EA have passed our case to their manager who seems really on the ball and hopefully can get things moving. Our new sol seems really good aswell and when we were in her office on Thursday she called the sellers solicitor while we were there and seemed very intimidating on the phone.
She has also sent out a letter like she said that she would and the copy that we have received gets the point across very well commenting on how patient we have been and how we will reconsider our position soon if no progress is made.
I will post another update when we have more news.

Todays update
I spoke to the EA in the morning and they said that they still had no contact with the Mrs (seller). Frustrated with progress I called the Mr (seller) and managed to get through. He said that he was as frustrated as we are and that he is desperate to sell. He said that he had seen the Mrs at the wekend and told her to go into the EA as they needed her to sign some paperwork. He also said that the mediation should be happening soon and that he was just waiting for a call from them so he could make an appointment. I said that we were worried about the whioloe thing falling throiugh and he said that there was no way that he would let that happen. He then said that he had received a call from the EA and they had said that the Mrs had called in there today but that the paperwork wasnt there for her to sign. I was shocked as I had spoken to the EA earlier and they had not mentioned that she had been in. In fact they had said that they had no contact with her yet.
A little later I had a call from the EA and aske dthem why they had not said that she had been in. The were a little short with me and said that they had not seen her. The EA that the Mr said had called him said that there was no way that she had spoken to him because she had been out of the office all day which I knew was not true as I had spoken to her earlier. I decided to pick my battles and asked instead if there had been any progress. The EA said that they had sorted the paperwork and that the Mrs is coming in tomorrow to sign it and that after that we would be looking at completion but then she also had said in the phonecall that they hadnt been in contact with the Mrs. It didnt dawn on me until afterwards that they had said that she will be coming in tomorrow and yet they had not been able to contact her so unless she is psychic I dont know how they wilol achieve this but we shall see.
The EA's comment about looking at completion almost made me laugh. Firstly because its about the 50th time they have said that and also because they know full well that we are still waiting for the mediation to take place and that the solicitor still hasnt heard from black horse with regards to removing the Mr's debt from the title.
So basically we have spent all day not really getting very far.
The Mrs may or may not turn up tomorrow to sign the paperwork.
They may or may not be getting an appointment for mediation soon.
And Black horse may or may not send the fax tomorrow to the solicitors.
I will get back to you tomorrow and let you know so keep everything crossed for me.0 -
Todays update
I received a phonecall from the sol's this morning saying that they had spoken to the sellers sol's and that they had said that we are ready for completion. She said that they have agreed a date of the 24th August as completion date. I asked her what had happend with having to wait for them to go through mediation etc and she said that all we needed to do was view the house again asap to ensure that it is completely empty and that there has been no damage and then we would be ready.
As we have been given completion dates in the past that have come to nothing we as not as excited about the news as we should be. They sol's called again this afternoon to say that they are sorting out our file and that they needed to have a copy of the policy for the buildings insurance sent through. I called the mortgage arrangers who said they would fax that through straight away and so hopefully that is sorted now.
We are going on Friday to pay the outstanding balance at the solicitors and and in the last bit of paperwork. Then on Saturady we are going to look over the house and then after that it is just a matter of waiting but seeing as we have been waiting for 5 months I dont think that a week longer will make much difference.
I am hoping that the EA will go with us on Saturday rather that the Mrs (seller) as I dont know if I can be trusted not to clout her when I see her as she has been a thorn in our side for months LOL.
I am also a little confused as when I told my mom that completion was the 24th she said is that the same as exchanging contracts and to be honest I am not sure. They definintly said completion was the 24th not the exchange of contracts so will that be done before then, after then or is it the same thing. And what does that involve? Do we have to go to the sol's and sign something or is it just done between sol's. We have waited so long to get to this point and now I am entering unfamiliar territory. This is the first time we have ever done this and I am finding out just how little I know about this sort of thing. I feel embarrassed asking these sort of questions and so please be kind with your answers:o .

i really feel for you. we had a trying ordeal while selling our flat and finally completed last friday.
we were on the market in feb 2007. found a buyer end of feb 2007. he had a flat to sell as well and found a cash buyer. so all in all a chain of three and everything straightforward. i agreed to a completion date after 1st may as my mortgage deal ended then and that gave enough time for a simple deal to go through.
they kept promising an exchange date of 31st of may. i thought it was going through but something did not seem right. my solicitor did not hear from their solicitors at all and last contact was mid april. anyway, the day before the exchange, the EA calls to tell us that his buyer had pulled out. so all in all they had no contact with my solicitor about exchange and now they pull out. they find a new buyer part cash in june and the EA says that they are taking the mortgage from their in house broker so they can keep a look out for progress. in the meanwhile nothing happens. there are complications (why no one knows, their solicitors are still very difficult to contact). finally end of july, i am told that we are exchanging on 1st august and completing on 10th august. i dont believe it. my solicitor is faxing, calling and emailing them but no proper response. surely if you want to exchange on the 1st, my solicitor should not be the last person to know. anyway, 1st comes and exchange cant be done because one or two enquiries of my buyers flat sale are still outstanding and his sols have to fax the reply to his buyers sols. i dont believe any of it. anyway, come august 2, i kept badgering them and my EA (to their credit) kept badgering as well and finally we exchange. i cannot believe it. and last friday we actually completed as scheduled. feels really surreal,
sorry to hijack your thread, but i felt that you could do with hearing an ultimately happy ending tale. is countrywide property lawyers involved in this sale. they are the absolute pits and have such poor work ethic, communication and use every trick in the book to avoid doing anything
goodluck with your sale. meanwhile stop worrying. what is the worst that could happen if this sale falls through. look at the consequences of following this sale and see if you can handle it. if you can, then keep the pressure but stay emotionally detached and one day it might happen when you least expected it.0 -

Exchange and completion are different. Exchange norammly happens a week before, but it can take place with less time as long as your solicitor has notice of that.Everything that is supposed to be in heaven is already here on earth.

Exchange is when the solicitor's happy everything is in place, including your mortgage funds.
The formal contracts are exchanged - and at that point there's no more messing about and your actual date to get the keys/pay is set in stone.
Completion is the date you get the keys/pay.
Once you have exchanged, you will know your completion date and you can make all the plans you want, KNOWING it WILL be happening.
On completion day, you will await a call from your solicitor telling you it's happened - and you will then go to pick up the keys (usually from the EA).
You can expect the call to occur about 2pm probably.

This is a really really rotten thing to be happening the first time you buy a house!
I would definitely inspect it before you exchange contracts, and take photographs of the condition it is in then. Also make sure you have insurance in place from the day of exchange. It sounds like this has been a very messy divorce and its not beyond the bounds of possibility that the ex-wife will trash the place before you complete by ripping out kitchen units, rads etc. At least if you can prove the condition when you exchanged contracts, then you can sue her if this happens (assuming you can find her of course) or claim on your insurance for any damage.
I hope this is just me thinking the worst, but this whole saga sounds like a total nightmare. My parents in law had a much toned down version when they bought their last house and when they moved in the occupying spouse had stripped literally everything out of the house (even stuff listed on the F and F form) with the result that the whole place which had looked OK when they viewed it, needed to be redecorated from top to bottom immediately.0 -

Call your sol tomorrow to make sure they received the fax. When our sol didn't receive a fax that was promised, the first we heard about it was a few days later when I called to see if we were nearing an exchange date to be told they were waiting on some paperwork. The paperwork they were waiting for the fax that should have been sent.
I went bonkers!!! No-one had thought to let us know so I could chase it up!

Todays update
Thanks for the advice, I called the sol and they confirmed that they had received the fax and it was fine. I called the EA again to ask about the viewing on Saturday and they said that they still hadnt been able to contact anyone to arrange it but they would give me a call tomorrow.
I havent been well all day (vomiting and stuff ewww) and didnt feel like pushing it with them so hopefully if I am feeling better tomorrow I will call them and let them know that the viewing must take place on Saturday.

***Todays update*****
By 2pm we still hadnt heard from the EA about the viewing so I called them and asked what was going on. Spoke to a woman there who originally put us on to the house. Had a bit of a laugh with her (what else can you do at this point) and told her it was all her fault. Sha said that there was a lot of stuff going on between the sellers that she cannot really talk about all she could say was that it looks like the Mrs has changed her phone number again so they cant get hold of her.
The woman at the EA who was calling me every day up until about two weeks ago has left due to illness and I joked that it was probably a nervous breakdown due to having to deal with our sellers.
The EA said that they still cannot get ahold of anyone to arrange a viewing so they would try and arrange one in the week. I explained that my husband works until after 7pm and that I dont drive so I could get to the house. The EA was really nice and said that she lives five minutes away from the house so if they can get hold of one of the sellers (they have a set of keys at the EA but need a sellers permission to go there) she will meet us there in the evening as she can go round from her house and be there in minutes. Thats a real help as otherwise we wouldnt be able to view until next Saturday which would hold things up again.
She also said that she was really sorry and that this has been going on long enough so at least she is sympathetic.
Anyway thats all thats happend today and I doubt we will get any news on a Sunday so once again we must return to the horrible limbo that we are in. The deadline is getting nearer but I can see light at the end now.
