    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    In particular, if they manage to get the registered keeper's data & write, then there will be something NORTY going on which could get Roxburghe in big trouble.

    Look how small the writing is at the bottom of the sign as a 'warning' about adverse weather conditions and that 'the surface may be slippery, please take care'!!!!!! Obviously just to cover the scammers against being sued if someone breaks their leg rushing back worrying about illegal clamping!

    And yet..and yet... on the back of the piece of rubbish they reckon they can involve/offer POPLA and on the front it says they may apply to the DVLA (in both cases that's only for AOS members!).

    Got a pic of the sign as well?! We would love to see their t&cs on their signage! :rotfl:

    Send an email to the DVLA, with those attachment pics, asking ''are this bunch allowed to get my data, if not why are they claiming they can and referring to POPLA when I can't see either named firm on the AOS scheme list? Please confirm by return that neither 'Car Parking Management (Cumbria)' nor 'PCN Parking Services' could get my data as registered keeper. And if not, what action you will take to force them to remove the wholly misleading mention of 'DVLA' and 'POPLA'? A strong and detailed referral to Trading Standards by yourselves is required I suggest, at the very least.''*

    * edit - see below for other dirt about the PCN Parking Services website and claims and links on it. Add them to the DVLA complaint and you must also report them to the ICO and the BPA for using logos they are not allowed to use.

    Hi Coupon-mad

    I have been to trading standards this morning and they tell me PCN Parking Services acting on behalf of Car Parking Management (Cumbria) are AOS members through Northern Europarks Limited also t/a Car Parking Management (Cumbria).

    So it appears they can get the RK details.

    I am aware this is a civil matter and that the Parking Charge Notice is not an enforceable notice. It is merely a matter of trespass and all the person driving the vehicle would be liable for was the loss incurred (14 mins = 20p).

    Would you suggest the driver appeals, I am the RK, but was not the driver on the day.

    If you have another look at the link I sent it clearly states on the bottom Northern Europarks Ltd T/A Car Parking Management (Cumbria).

    Do you suggest I appeal, or write to state it is not enforceable, or ignore.

    All help greatly appreciated.

    My understanding is that it needs to state that the company is Northern Europarks Ltd on the sign, otherwise they are not informing you of who the other party is in formation of said contract. The upshot is that there's no contract.

    I do see 'Northern Europarks Limited' on the AOS list but do not see 'PCN Parking Services' so that will be a point among many for your POPLA appeal in due course.

    But personally - because of this tangled web of names, I would WAIT in your case, and see who writes to you as the registered keeper.

    Do not respond to the fake PCN yet, I would want to see who sends the 'Notice to Owner' having forced 'them' to apply to the DVLA. Even if it's the named AOS member who sends the Notice, I would then email the DVLA and ask a few questions, complain, see exactly when they apply for your data and exactly which legal entity does so... The DVLA email addyy (which does get replies) is [EMAIL="FOI@dvla.gsi.gov.uk"]FOI@dvla.gsi.gov.uk[/EMAIL]

    So, only once you get the Notice to Owner and have emailed the DVLA, I would advise you to then take the same sort of approach as I just advised this poster to do with a fake PCN from AEJ Management:

    So that will be a challenge against the legality of the fake PCN, demanding to know on what basis it's issued (as per the pepipoo thread I linked in my latest reply). You can also throw in questions about the names being different on the signs/PCN and that the ticket wasn't even issued by the AOS member so how can you know which legal entity is behind this fake PCN? The upshot being that the party/ies involved have been deliberately made unclear to a driver by misinformation in their documents and tiny writing, illegible info and outdated/misleading claims about towing on the signs - which is probably a breach of the Consumer Protection from Unfair Trading Regulations 2008.

    Because we've never heard of this PPC, they are certainly not a big player - so I 100% PREDICT they will breach the BPA Code of Practice in various ways. Make notes of the dates of each letter & when you receive them, and the deadlines they set, keep a diary of this before you get to POPLA.

    On that thread I linked the BPA Code so you could have a look-see at what the 'must' say on their signs and on their fake PCNs, and what they 'must' do when dealing with appeals. They will fail and then you can swoop and kick sand in their face at POPLA, at the PPC's expense. You'll win it at POPLA and it will be fun. :)

    Do I not have to appeal within 28 days, and appeal to the ticket issuer before going to popla?

    Please note that, POPLA will not accept your appeal, if you have not appealed to us in the first instance & have been given a unique appeal reference number by us.

    What is your advice folks?

    Read the forum about POPLA and you'd find that you have to appeal to the scammer first, before POPLA.

    But the registered keeper can appeal, they have the same right of appeal. So there's nowt wrong with waiting for the Notice to Owner/Keeper then responding to that as the rk, not saying if you were also the driver and NOT mentioning the fake PCN of course, why should the keeper know there ever was one?

    I have had a letter from:
    Car Parking Management (Cumbria)
    PCN Parking Services
    PO Box 465
    Lavender Park Road
    West Byfleet
    Surrey KT14 9BS

    This is a PARKING CHARGE NOTICE - NOTICE TO KEEPER

    The letter states that the PCN has not been paid and states it is too late to now pay the discounted amount, amount now due is £95.

    They also ask to disclose the driver information.

    It states on the bottom of the letter "Northern Europarks Ltd trading as Car Parking Management (Cumbria) is registered in England No. 07053391 Registered Office: Barnett House, 53 Fountain Street, Manchester M2 2AN

    Not sure what my next action should be, what would you suggest please?
