DLA - my Carer has left! what to do about the carers allowance

    Well we did apply for carers back in June and it was refused. We have not applied for it since as we thought it would auto be issued once the appeal was heard, and no I don't really understand it all, and I have never applied for any of this in the past as I was not disabled until a 14 months ago, so sorry my lack of understanding, it has never been explained to me nor have I received a letter from DLA or CA, only asking for my bank details and a couple of basic questions following the hearing an thats it so far. I was worried as I thought the order by judge was for CA and I wanted to make sure everything was all above board etc. I still dont know at all whether what the judge ordered is CA or just care component? so I will have to ring dla tomorrow and find out exactly what is what, as I dont get quite quite frankly, but thank you all for your help and replies much appreciated

    Hi yes, I have amended the ESA to the best of my knowledge my ex is applying will be applying JSA, its just confussing as the order by the judge has confused me. My ex has no bank account and his mail still comes here too as he only left very recently, and neither one of us received any formal letter as yet, but its is early. I remember my friend got back payed unexpected and received the dla letter a week later, so I will have to ring the and find out I think,, thank you x

    The order from the judge was regarding your DLA, the care component and the mobility component.

    You say you applied and it was refused, so you got nothing for carers allowance, it isn't automatically issued.

    you really need to stop him using your bank account and to get his own.
    and you must make sure his mail is redirected to where he is living now.

    if you dont, you may have trouble with benefits, as they may refuse to believe that you are not a couple.

    You're probably going to have to make several phonecalls to different departments.

    I think the main thing is to tell everyone that he's left, and find out just what benefits you're getting.

    So you need to contact:

    Disability Living Allowance department, find out what components you're getting.
    ESA department, find out what kind you're getting (income or contributions, and support group or work related activity group).
    Housing and Council Tax department, to tell them that your partner has left, what you're claiming and what you should be claiming.

    It sounds like your partner has dealt with all this and kept you in the dark about what benefits you're on.

    I think that someone above gave good advice about looking at your bank statement. If you look at the payments going in they'll start DWP and then give your national insurance number. After that there'll be some more letters - tell us what those letters are and we'll be able to help you figure out what benefits you're on.

    Nannytone is spot on though, you need to seperate your finances etc so that you can prove your partner has left. Otherwise they'll say he still lives there and it will effect what you can claim and the amounts. Start putting his post back into the letterbox marked 'not at this address' if he can't be bothered to change it himself. And have him taken off your bank account, if he's on it. Cancel any cards he has to your accounts, otherwise he could take all your money.

    I know you're probably still reeling from him leaving, but it all needs to be done quickly, otherwise you could end up getting money you're not entitled to, or losing out on money you should be getting, and will be difficult to untangle it all.
    Unless I say otherwise 'you' means the general you not you specifically.

    Just to add to Ames little list. Child tax credits if you're receiving them (although I think i mentioned them earlier)

    But hon, I can see this is extremely confusing for you. And it looks like you need real advice on it. It might be worthwhile you contacting your local council to see if they have a Welfare Rights Officer who can help you work it all out.

    It now looks like your x has not been getting carers allowance for you from what you say. But you really need to find this out for sure. The benefits office dealing with your claim should be able to tell you. Even then you should be able to let them know that he's no longer caring for you and that you live alone, they will then be able to advise you further.

    Hi All,

    I am now in a position to clarify some of the confusion outlined in my other post (My carer has left!). In addition, I will copy & paste this into that post)

    Firstly, I posted this topic separatley to save on any further confussion (more for my sake that any) as the servere Disabilty Premium was un heard of to me until, in brief, was mentioned on my other post, upon which I hadn't ask much about due to the fact the other post was regarding DLA and Carers Allowance.

    In brief both my ex husband and I had always been a working family, until my daughter become ill and severly disabled as did I some months later. As a result we had to stop working and applied for full benefits, something we have never done,needed or had to apply for before.

    We were apponited an Occupational Therapist, who helped with all aspect, we made contact with all the benefits departments, and never once was informed that I could or should apply for C.A in relation to my daughter (who received DLA before me) from the point of when her DLA was awarded no C.A was received as I never applied, it was an area that was never mentioned when I made my enquiries.

    I have now asked for the C.A Application forms to be sent to me and my O.T wil help me fill them and send them accordingly. As a result of this when my DLA was awarded this came with some confussion! We received the C.A forms, fillled them in and sent them of. As said in my other post we received a basic letter asking for bank details to process the payments, although the letter didn't identify directly what this was for.

    After me making enquires yesterday it is as follows:

    Make new claim for C.A in relation to my daughter
    The letter mentioned above was regarding DLA and nothing else.
    The C.A application for my husband has been received, accepted and they no know to only pay up to the 4th March, as my husband and the O.T spoke to them and explained the current situation.
    We will receive the monies for this to that date, once the have they ammended and issued the claim, which at present is still in progress.
    The money I received in the bank was a back payment for DLA only after being awarded it by the judge, but no letter as yet has been received to confirm my amounts or payments.

    I was very thankfull to all that responded and tried to help as highlighted in my post and I made it clear that I didn't understand it all and it was confussing.

    Regarding the person (NANNYTONE) who feels it is appropriate to be judgemental, very rude, harsh and in my opinion insulting!! really should get the chip of her shoulder, rather than take offence because I asked seperatley about the Servere Disability Premium!
    I will not appologise for my lack of knowledge or understanding of the benefits system, just because I am new to it.
    Nor will I accept NANNYTONE diabolic un nesecassary rude comments and insinuations!

    I have suffered a stroke, in additon I have M.S and Epilepsy and am on strong medicaiton.

    And I can just about manage to type, and use correct gramma and punctuation; NANNYTONE should use her time learning how to write correctly as the spelling is appalling as is her attitude.

    Melsy, you are entitled to your opinion about the posts from Nannytone - or anyone else for that matter.

    However, before you comment further about Nannytone's spelling, I feel I should point out that she is severely visually impaired. That is why she uses bold font when she posts. It is her typing that is 'at fault' not her spelling.
