DLA - my Carer has left! what to do about the carers allowance

    My husband doesnt receive the money it goes into my account, however, he moved out yesterday and hasn't spoken to me or rang dla?? iv tried to ask him what to do and if he is gonna ring them but his not repsonding, although he did send a text asking for some of the carers money and I said no, as your not caring for me anymore?

    Maybe if you could confirm the amounts of money going into the bank it may be easier for us to work out who is getting what. If you get DLA highest care component and lowest mobility thats 98 a week.

    Carears allowance is 58.45 a week.

    It seems that the benifits YOU are getting are DLA high rate care and low rate mobility, thease are yours and they go into your bank.

    There is no such thing as high rate careers allowence, it is just a set rate of £58.45 per week. If your husband claims this for being your carer then I think it would of had to go inot his bank account and not yours, if he has no account as you say then I doubt weather he is claiming it??

    ok,, well im am confussed to, Iv just dug out the hearing judgment to see if this sheds any light as I have not yet received a direct breakdown from dla themselves: the order says MRS N (MYSELF) is awarded care component at the highest rate and Mrs N (myself)) is awarded the mobility at the lowest rate for an indefinate period.

    So I then received a form to fill in and my appointing my husband as a carer, and then a form to ask what account I wanted the monies paid into, as they owe me back pay which has gone in to my account I cannot work out the exact amounts as it was one lump sum and the new monthly payments are due in 3 weeks but I still have no letter for the actual award.

    So is the money awarded to me or not and can my husband change the bank account or cancel it behind my back? as I an happy to report the change if it is needed, but because I dont understand who is getting what, im not sure, my husbands seems to think that I am suppose to split the back pay, and I have refused. and as said earlier, he has text me asking me for money and saying its his, but the judge ordered it to me. Any advice hope this helps a little x x

    From that it seems that you have been given both care and mobility elements of DLA and your husband has no right to any of it. He would have had to apply for carer's allowance in his own right as you got DLA and he was caring for you at least 35 hours per week.

    Melsy27 really sorry to hear you are going through such a dfficult time with all of this.

    One question here we've established now that you are getting

    DLA Higher Rate Care
    and Lower Rate Mobility Allowance

    Are you as a family on other benefits i.e. income support?
    The most wasted day is one in which we have not laughed.

    I am in receipt of esa and full H/C tax benefit. Neither of us work. Hope this helps x x

    You really should call them and tell them that your husband is no longer your carer. And that he's no longer on the scene.

    It would be beneficial to know what other benefits you claim, so we can send you to the right people. Like Child tax credits.

    Edit: now see you've listed some.

    Call Housing benefit/council tax benefit. Make a new claim as a single parent.

    ESA - Call them too, because you may have been getting IR ESA for your husband too.

    Child Tax Credits - Again a new claim as a single parent.

    These are the ones that spring to mind at the moment

    Have a look here https://www.gov.uk/dla-disability-living-allowance-benefit/what-youll-get it gives the rates of DLA care and mobility , it may help you work out just how mauch you are getting?

    DLA is awarded to the disabled person, which is you, so your husband has no right to it, doesn't look like he has been claiming Carers allowence at all for being your carer?
