Well we have received the money, and our first payment would of been due in 3 weeks. However that will not be received as I have to change it. I am sure we did apply for CA back in June, but as I said it was refused and went to appeal. I have re checked the order made by the judge it stipulates that I will be awarded High rate care component and low rate mobility indefinaltey. I have read it thoroughly and I dont think youneed to be at middle rate to receive carers? unless of course the care component awarded to me is not carers allowance then I am even more confussed than before. :eek:0

You have to have medium or high rate care to get carer's allowance. If he has been granted carer's allowance then he is no longer entitled.Lost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

you do have to be getting at least middle rate care for anyone to be able to claim carers allowance.
it isnt an opinion, it is a FACT
you have not been awarded carers allowance. you have been awarded DLA, a totally different benefit.
carers allowance is awarded to the person GIBING the care... not the person who receives it
carers allowance is claimed using a seperat form, and can only be claimed AFTER an award of middle or high rate care DLA has been awarded0 -

i just think the OP doesnt understand how DLA and Carers Allowance works.
if the appeal was only won in feb, then its highly unlikely that the xarers allowance claim has been processed yet.
this claim needs to be stopped immedialtely.
although the backpay ( from jume until now) should go to the husband, if he was the one caring for the OP)0 -
Sorry I am totally confussed!! maybe then from reading the threads that we were not in receipt of the carers allowance? and that I have got it all jumbled, so under normal circumstance I guess we would apply now, not thats going to happenas we are no longer living together, so if we were never in recipt of the CA then0

possibly the carers allowance isnt in payment yet. but only you and your husband will know if you applied for it.
you really need to find out.
it wouldnt be paid together with DLA, but would come as a seperate payment.
if no one is claiming carers allowance for you, and you are getting income related ESA, you should also start to receive the severe diability premium and the enhamced disability premium, as soon as you remove your husband from your ESA claim.
this will give you a further £60ish a week0 -
Can you get a copy of your bank statement OP. Sometimes we can work out from that where a payment has been made from. The DLA lower rate mobility and higher rate care are yours. No doubt about that. The ESA is yours, but may have some awarded for your spouse. If there's any carers allowance been awarded it would have been awarded to him. You could call your benefit centre and see exactly what's being paid and inform them that you are no longer with your husband and they will alter the claim.
Or if you have a copy of your bank statement. There are usually some letters behind each payment, where you can see what the payments are for.4 Stones and 0 pounds or 25.4kg lighter :j0
