DLA - my Carer has left! what to do about the carers allowance

Ah ok thats great, I will inform them, but he's text me again asking for the carers money? I thought I was awarded it, do I have to give this to him? and can he alter my claim? as I am ringing dla tomorrow and tellling them he no longer cares for me and I will ring the other depts too. He just keeps demanding money and saying he is changeing my bank details on dla? well he cant surely?its my account, thats why I came on here for advice, he only left yesterday, I'v not had chance to change anything yet, I was seeking advice first. So thank you to all thats has responded now know hwo and what to change x x x0

Tell him to bog off. DLA is for YOU! If he wanted Carers allowance then he should have claimed it when he was caring for you. He has no right to any of your DLA as it is down to you how it is spent. He can't change the bank details for DLA, but I'd still call to let them know he has gone & is trying to steal your money, because that's what he's trying to do, in effect!!Noli nothis permittere te terere

He can't alter your claim but it may be an idea to let DWP know that he may contact them so they can put a note on your claim.Lost my soulmate so life is empty.

I don't think it is entirely clear that the OP's ex is getting Carer's Allowance or whether she was just referring to the fact he was caring for her managed to get her the higher rate care of DLA>
It would be a good starting point for her to find out exactly what she is getting.

Sorry to hear you're having such a rough time. Do you and your ex have a joint bank account? Could that be why he is saying he'll change the details?
What you need to do, is make yourself a nice cuppa, put your feet up, and prepare to have to wait for the phone to be answered and then phone up the DWP and ask:
1) How much is the back pay that you are getting?
2) How is this made up?
3) When is it to be paid into your account?
4) When will your first payment for DLA be?
5) How much will you get every 4 weeks?
6) Is there anything being paid into your bank for Carer's Allowance?
Then let them know your marital situation and warn them that it's possible your ex will phone. I've found myself that phoning any governmental department requires me to answer such a myriad of questions, that I doubt they will say anything to him except "no"!
It would also be a good idea to write down on what dates you are due your various benefits, as that will help with your budget. HTH

ok,, well im am confussed to, Iv just dug out the hearing judgment to see if this sheds any light as I have not yet received a direct breakdown from dla themselves: the order says MRS N (MYSELF) is awarded care component at the highest rate and Mrs N (myself)) is awarded the mobility at the lowest rate for an indefinate period.
So I then received a form to fill in and my appointing my husband as a carer, and then a form to ask what account I wanted the monies paid into, as they owe me back pay which has gone in to my account I cannot work out the exact amounts as it was one lump sum and the new monthly payments are due in 3 weeks but I still have no letter for the actual award.

The DLA high rate care is yours - so is any back pay that you get. This money is to pay for things you need to purchase that are related to your disability. These can be things like walking sticks, vision aids, hearing aid batteries, pre-chopped veg - anything really. You don't need to account for this money, it is disregarded for most benefits and the government never ask for invoices.
If you apply for help with care from social services then they may take your DLA into account and expect you to contribute some of it towards the care package.
When someone is claiming DLA care at middle or high rate a friend or relative who provides 35 hours of care per week and isn't a full time student or earning over £100 per week can claim carers allowance. This allowance is claimed separate to DLA and goes direct to the carer.
If someone wants to claim carers allowance for you the DWP would have sent you a letter asking for your signature and telling you that the claim might affect income based benefits that you receive. If you've not had this letter then your husband hasn't claimed carers.
As you're an adult with capacity the DWP won't listen to him if he calls to change your claim, if it makes you feel more secure you can call them and tell them you are no longer partners and you do not want him to deal with your claim.
This situation could lead to him maliciously reporting you for benefit fraud - if you get a letter to this effect DO NOT PANIC. Let the powers that be visit, they're usually very nice and explain things well and you'll probably never hear from them again.0 -

It still isn't clear though as she goes on to say (after the bit in bold) they sent her a form asking her where she wanted the money to be paid.
The CA claim would be in HIS name, not hers and so she wouldn't have any say over where the money was paid.
Very odd, and OP definitely should confirm what is being paid.

To me it seems the husband is claiming carers allowance. DLA forms do not ask for the details of who is caring for you, maybe she can't remember the carers form was addresed to her husband and she only had to sign to confirm he is caring for her.0
