Ex taking me to county court for gifts

Sorry to hear about this waste of space, happily all this is only making you a stronger person, not making you collapse like a pack of cards, if you can get through this you can get through anything, especially if you managed to stick in a relationship with a tool like him, what worse could you possibly face??!!!!!!!
On a serious note, could he have forged your signature on anything? Is that his evidence? Hopefully that could be proved if thats the case, let it go to court and they can have all the evidence in fron of them, can you get a copy of the police report of the assault on your bf? Did he have any medical treatement. Could you get any signed statements from people he has slandered you to? You may be able to chuck in a counterclaim!!??0 -
Hi, I don't think he has signed anything for me ever (forged). Could he say a text was proof? I havent sent any but if I've said anything that sounds like a promise for anything he might use that! lol might be being a bit paranoid there. I really think he needs to move on now. Yes my boyfriend did take mediaction for his serious black eye and cheekbone injury - it was'nt a merry christmas thats for sure, when he alled me the early hours of christmas day to tell me my ex had attacked him. He was called me a sl*g and shouting abuse about me in the street! I could include this in my counterclaim prehaps but I would need a witness other than my boyfriend wouldn't I?
I will be able to get a statement from the police yes so hopefully my case agaisnt him will be better then the rubbish he comes out with they will see he is a bull sh**ter and will be able to see that I'm helpless and just want to get on with my life. Should I say this in court? That I just want him to go away and that he can't move on?
I know this is true because he has been going counselling and I could get proof of this but it would be very difficult as it is all confidential. I saw him the other week and we literally slid past each other in the corrider and I looked him dead in the eye and he sort of said hello (prehaps nervous). I then went to the uni canteen and spoke to some people there for a while, then I thought I want to sort this out so I went back to where he was and that's when I heard him in the counselling room saying that I looked scared of him when we walked past each other and that I must have been, simply because I cocked my head to one side and stopped speaking to my friend when i saw him! I think he has gone around the twist! All the while I can't help thinking how sad it is that it has come to this - we were good couple at one point and thats why I find it so odd that he is behaving like this.

When it gets to court just stick to FACTS. Do not speculate or say anything that you cannot prove. Let him say what he wants - he will end up shooting himself in the foot.0

Hi, again like many I am no expert on this subject, but can't you work out anything you spent on him such as beer in the pub, meals etc?????0

Hi, Ur boyfriend is definatly able to witness, get him to write a statement and any photos you may have of the injury's??? - Ur ex wont of submitted any evidence yet, it happens nearer the time when you go to court,

Is it the small claims court you are going to? If so it is common that nothing is submitted, appart from the claim & your counter info, until the day. He just has to say he has a claim.
But don't worry the judge will look at what evidence he has with him and what you have taken with you. He will make a decision based on this. If your ex has no evidence then he will find in your favour.
I have no experience of other types of cases (not small claims) maybe someone else can help if it is not small claims court.

Hi yes it is small claims court. So a claim can be put to the judge without edvidence? Yes my boyfriend will bring pics but will they find my story of him being a stalker/revenge relevant?
Im worried because my dad was saying that they wont want to know about the violence, just whether I owe the money or not. However, this is my defence, that he is a stalker so I believe it to be relevant. I put on the defence form about the violence and how bitter I feel he is. Also that i believed it normal to buy a partner gifts during a relationship.
:rolleyes:0 -
Hi Sallyanne,
As far as I am aware If it is in the small claims court then the case would run similarly to the current Bank charges cases and, therefore, about a month before the case is to be heard you will receive the "bundle" which your ex intends to rely on in the court. i.e His evidence!! Since it seems unlikely he has any evidence he may decide to call things off at this point:D
If things do go further it might be an idea (as previously suggested I think) to gather evidence of any "Gifts/loans" you may have given him during your relationship.
For what it's worth I think he's just trying to wind you up & if this even comes to court (which I doubt) he will just end up looking like a complete to$$er.
Chin up
Thanks to all who post comps :A :T0 -
I've nothing to add to what other people have said just hugs and hold your head up high, you've nothing to worry about!0

Sounds a touch like my ex, I have a thick skin and just said "see you in court", and never heard a thing, apart from a badly photoshopped solicitors letter.
You have nothing to worry about, shame he cant move on and get a grip.0
