Dont no if they are still going for damages. Im personally not interested in claiming for damages just going for the other. Its not a secret clan we,ve been asked not to give out senitive information, so you all will just have to respect that. 0.5% signage has no bearing on the outcome.

Ok I would quite like to go for the "other" too.

I joined this thread in its first cries for life (infancy) and the purpose was to find out what Bank of Ireland was up to. Through a lot of shared information we pieced together the fact that the affected mortgages were pre 2004, that the increase in differential affected Residential as well as Buy to Let mortgages, that no one had received the Residential Terms and Conditions (that one was me) and that the clauses shifted from product to product and everything else that is known. This information was researched and shared on this thread by everyone sharing freely and everyone should remember that our strength was in communication. The communication from the Bank of Ireland in its letter to those affected was deliberately obtuse and people here shared the contents of their telephone conversations (they cost money), their time (money) and effort etc without limiting what they shared with others. Its a great pity this information has all been bagged up and charged out for a fee.
I am grateful to those who have "put their money where their mouth is" but question why there is only one of them left posting here.

...and another thing: "0.5% signage has no bearing on the outcome".

Means what? that 99.5% will keep the rise in differential? I thought the point was to counter the creation of a precedent for other Banks to follow.

As I understand opinion cost £2000, & lawdepartment gets the rest as they looked at documents & done all the rest as they no longer need Barrister,

Ok, the law department has the money to be used for the"other". who are the law department?

BR Landlord, I completely agree with everything you've said .... I think it's all a bit strange what's happening with 118. I actually think that there is a bit of self promotion going on with regard to the site ....

I would be really interested in hearing from a residential customer who has complained to the FOS and if they've had any response.

This web site forum is for helping others, thats all Im doing, going over the whys & therefores is getting no where.
There,s been no signee thats come on here & said it a waist of money & dont sign.
If signee,s need to get more people to sign up then then they would be on here trying to persuade you to join, that should therefore tell you it does,nt matter how many sign up as mass back up is not needed. ( case by case). They,ve signed up & dont care about others which I feel is a bit selfish,
So there is no promotion going on on behalf for 118.
If anyone signs up hopeing to claim damages at a latter stage then I would think twice as that would need a very high amount of funding if you lose a great financial loss to all concerned.
Im not misleading anyone in anyway I do honestly think there a good case against the Bank. Ive no reason to lie as I dont need anyone to sign up to help my case. If however they do go for damages then we would need a high % of signee,s, but Im not interested in going down that rd unless I thought I had a very good chance.

Click on her name then click on find more posts, & you,ll see what she doe,s all day & most of the night,
A barrister is extremly busy taking case studies home with them, so they would,nt have enougth time to spend, as she seems to be doing on forums.
anyone can google Middle Temple & say they work there.
1 A Barrister would not say they sometimes get things wrong, they would just state they do not win all cases.
2 A Bassister would not lower themselfs to justifie there position.
At the end of the day it does,nt matter if she is or not, its my opinion that she,s not.

You will have noticed, perhaps, that I didn't post at all in the first 3 months of this year, when I was doing a 3 month-long trial. Barristers tend to be extremely busy sometimes, and less busy at other times.

I don't work in Middle Temple. I'm a member of Middle, but my Chambers are in Gray's Inn.

    1. Any barrister worth his salt would say that sometimes he gets things wrong.

    2. I don't know what a bassister is, can't help there.

    3. You are wrong; hope the rest of your opinions are, for your sake, less incorrect!
...much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.

I am grateful to Justin Selig and his website for the following link which I am sure will help us decide on whether to join in the Class Action:

    Sunday Times
TRACKER mortgage customers hit by a shock interest-rate rise are planning to take their fight against the move to the Office of Fair Trading.

Lawyers acting for some of the 13,500 Bank of Ireland (BoI) customers affected said they may have a case under the Unfair Terms in Consumer Contracts Regulations 1999 based on advice received from a senior barrister last week.

As a result, lawyers are now preparing a formal complaint to the Office of Fair Trading (OFT), which investigates potential breaches of consumer protection laws. It could order the bank to reverse the move.

There you go then OFT. If they take up the case it will be funded by them.
