If BoI did only get opinion from FSA. that explains the baristers opinion & why the outcome could be a good one, banks relying on human nature think you would,nt have a chance so we would,nt challenge.

    Barristers are sometimes wrong.

Goes against the grain to admit it, but we are all human (-:

Everyone seems to think there solicitors,FOS this FSA that. Im affraid your not, trying to be one is foolish no good listening to your mate down the pub. I will always use PROFFESIONALS where needed, Ive even Emailed Baristers opinion on to my solicitor for him to look at on my behalf, awaiting reply.

    I don't think I'm a solicitor.

I know I'm a barrister. Which is why I know that barristers are not always right.

I have no idea whether the barrister is right or not. I don't know all the facts, and it's not my area of law.

It's an opinion. If the law was entirely clear on this, it probably wouldn't be happening.

50 pages or 5 paragraphs, it's an opinion, not sent down on tablets from Mount Sinai.

I don't claim to be a barrister. I am a barrister. A member of the Honourable Society of the Middle Temple, 11 years' call, and practising.

Ive paid for this advice and so has many others so why would I therfore pass it on for free. No one to date has got of yet. they need to stop running around like headless chickens & pick up a sheeps head and join up. if they are to blind:cool: to see the wood from the trees then thats there problem. it will be no good moaning latter after the event. Its £120 with a 50/50 chance of winning thats odds I gamble at.
It's up to you guys. I'm not a BoI customer, so won't be paying in either case.

But I tell you one thing.
If someone on the internet says that they have some information that I would want to see, I wouldn't be paying money for that information unless I had reason to think that there was something in it worthwhile for me.

I presume that the class action will now cost more than the initial opinion did. So you need to be maximising the number of people prepared to pay for this class action, rather than the number of people paying for the initial opinion.
I think if it was me I'd be tempted to make the opinion public and (if it is as strong as you suggest) you will get the majority of BoI customers to join you in the class action.

I would suggest that those who were brave and paid upfront for the initial opinion should pay a reduced rate for the class action.

    I absolutely agree.

I wont be paying in to any situation where I read threats that there might be a gagging order and therefore the class action group would not be allowed to tell anyone the outcome, or for those in the know even at this stage saying you have to pay to find out what we found out. If there is more information which suggests there is a case then many more people will get onboard. 13,500 potential joiners. The opinion should be published and shared.

The costings for the 'opinion' have not been adequately explained and you have to trawl through a lot of posts to discover that the £120 is for the opinion and not for action, which just might have caught some early joiners out.

My gut reaction is I am a little uncomfortable with the methods.
