    They'd have been able to reclaim a % of the smp paid to you and that element they can't ask you to repay but omp is a different issue and each employers policy would cover returning and repaying

    I that the stuff I had at the start? Can she just ask for it back... Even if I don't have a contract and it was not mentioned when I left?

    If you just got statutory mat pay you won't have to pay it back its just if you got anything on top of that. Stat = 90% first six weeks them about £135 per week for 33 weeks.

    Only if it was payment on top of smp, as jonno says first 6 weeks smp is 90% of your average weekly earnings followed by 33 weeks basic smp. If the company have a maternity leave policy that would include details with regard to repaying omp, I know my boss never specifically mentioned it to me but signing my mat paperwork covers that I'd read and accepted the policy x

    Here is the link I sent to my boss about it, he's rubbish with anything like this so point blank refuses to talk about it with me on the phone so I'm having to go through hr to sort it which is a pain!

    I don't get paid after the end of September so I have to go back some shape, well it looks like we CAN afford it but OH has all the money and won't share it. Lol!
