    At least Tilt has learned you can reverse without a seatbelt.

    I learned that when i took driving lessons :D

    For what it's worth, the Road Traffic Act 1988, section 14, paragraph (2)(b)(ii) excludes the requirement to wear a seatbelt for "the drivers of vehicles while performing a manoeuvre which includes reversing".

    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.

    He should of beeped, she should of looked.

    Its dealt with now tho thanks to all the helpful advice he has never had an "event" before as the insurance company put it and hopefully it won't happen again.

    Here's a suggestion no-one has mentioned to prevent this from happening again - is it possible for people to drive forwards OUT onto the lane instead of reversing onto it? This allows the driver better visibility.

    All incidents have a point of no return for at least one party. Perhaps the point she actually started reversing the car was at a point that was too late for op to stop in time!

    Since your insurance have now been informed, there is no benefit to you personally to doing the repairs privately. The accident is on record and your premiums are going up regardless of blame. It also sounds like you don't particularly trust this person.

    May as well let them handle the repairs too, just in case there is more damage than just the wing. At least it'll get inspected by someone who knows what they are doing so you'll know the car is still safe.

    Since the damage is to the side of your car, not the front, as the neighbour was reversing onto the road, I don't see how this can possibly be your BF's fault.

    Thanks lum, he has had to claim as the car is pulling to one side when you drive it in a straight line so it getting picked up on Monday and hire car getting dropped off, might tell him to put the old wing back on I can't remember weather or not he told his insurance he replaced it......

    Have asked for her insurance details but she has refused to give us them, so have gave our insurance company her reg, name and address so hopefully they can get something from that.

    You should almost certainly put the old wing back on, otherwise they will think you are trying to claim for existing damage.

    Think about it, an undamaged wing but you're claming she hit you in that wing and now the car is pulling to the side. It looks dodgy as hell.

    Your insurance should almost certainly be able to get her details but even if they can't they will just send the claim to your neighbour who can either handle/pay it herself or pass it on to her insurance.

    She's digging herself into a hole. Let the insurance company handle it - that's what you pay them for.
    Probably is better to put the original wing back on though.
    His premiums will increase unfortunately, but you should get the car put back to as it was before the accident. Make sure you tell the insurers, and the people picking the car up, that it now pulls to one side.
