    You need to get her to say she was reversing at the time of the accident. Get him to say something like "as we were both moving at the time of the accident, I suppose it must be my fault". If she goes for it then let her hang herself.

    If she hit the 'side' of his car, then it is 100 per cent her fault. She hasnt looked properly. full stop.

    Thank you I think she realises this as she has just knocked on the door asked to speak to me... I don't drive.... and has basically said it will be much more cost effective to fix our own cars and she will let my boyfriend off "just this once" ...... she has told me her excess is nearly £700 and both our premiums will increase...... I told her ours is only £150 excess.... I don't know what to do now.

    My boyfriend is worried that he will loose his no claims and his insurance will increase.

    What should we do?

    What her excess is, is no problem of yours.
    If the damage is minor and can be cheaply repaired, then it probably would be cheaper than going the insurance route. But, that is why you have insurance and if she has claimed whiplash in the past, there's nothing to stop her doing it again. You should at least inform your insurance company "for information only" even if not claiming through them.
    BF could well lose his NCD if it is not protected, and premiums could go up even if the insurers decide it's not at all his fault. That's just the way life is unfortunately.

    Really useful info thank you. Her boyfriend has just knocked and ad he is willing to swap wings with us as he has the same shape and colour corsa as us.... dunno about doing it but nice of him to offer

    How on earth did they not see each other, specially the one that was going forward ie reversing lights at least.

    Just pass everything to your insurance company, that's what you pay them for.

    Your are probably correct that wearing a seat belt will not be relevant BUT I think you are mistaken about being allowed to reverse without wearing one.

    The seatbelt is not material to who has overarching liability for the accident however it can be brought up as contributory negligence should the non-fault party be the one not wearing a seatbelt, they make a PI claim and it is shown that had they worn the seatbelt then the injury either wouldnt have happened or would have been less.

    You are allowed to reverse without a seatbelt.

    If she reversed out of a space into your side, then I would imagine there's a good case that she is mostly responsible, especially if she had limited visibility to reverse into a road...that's why it's recommended to park with your front facing outwards.
    Draw a good diagram for the insurance company and let them sort it out.
    tbh a small dent in your wing might just pull out and be acceptable, so it's what she wants to do about her bumper. If you are lucky then your panel could be fixed cheaply, so just inform insurance company for reference only incase she pulls a fast one on you.

    I have been out and the dint is really bearly noticable, so its very livable, and it will match the one near the boot on the other side that I did a few months ago with a trolley in mr m`s lol, my boyfriend has rang our insurance and informed them of what happened, they have said they have noted it all down.

    My worry about the whiplash this is about 2 years ago I made a comment like its Monday your usually at work day off? She replied with no I got a compo claim, month off work and £2500! Easiest money she had ever made apparently!

    Thank you all for your advice, am just glad my kids and her kids weren't in either cars!

    You dont have to wear a seatbelt while reversing according to the law.

    OP if she reversed into you bf car it is her fault, if she says she was stationary when the collision took place it s adifferent kettle of fish.

    If it was me I would let the insurance handle it telling them the facts
